Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota was held on the 5th day of
November , 1984. The following members were present: Ming Mayor
' Neils and Crain
The following members were absent: Mayor Davenpor , Councilmember Moen
Councilmember Neils introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 84-773
DIRECTING THE CITY CLERK WITH RESPECT TO THE FILING OF RESOLUTION NO. 84-772
WHEREAS, the City Council of the City of Plymouth has authorized the vacation
of a poriton of 28th Avenue adjacent to Medicine Lake Estates 3rd Addition; and
WHEREAS, the vacation is only necessary if the developer proceed with the
platting of the proposed addition;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OB
PLYMOUTH, MINNESOTA as follows:
1. That the City Clerk is directed to not file the resolution
vacating the aforedescribed right-of-way until such time as
the following conditions occur:
That said vacation shall not be filed until such time that
the owners of the Medicine Lake Estates 3rd Addition plat
have received title to said vacated street and provide the
previous owner with a perpetual easement for lake access
purposes.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Schneider , and upon vote being taken thereon, the
following voted in favor thereof: Acting Mayor Schneider, Councilmembers Neils
and Crain
