HomeMy WebLinkAboutCity Council Resolution 1984-772I CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the .5th day of November , 1984. The following members were present: Acting Mayor Schnei_ Counci members Neils and Crain The following members were absent: Mayor Davenport, Councilmember Moen Councilmember Neils introduced the following Resolution and moved its adoption: RESOLUTION NO. 84- 772 AUTHORIZING THE VACATION OF 28TH AVENUE NORTH ADJACENT TO THE MEDICINE LAKE ESTATES 3RD ADDITION WHEREAS, the petition to vacate a portion of 28th Avenue North in Registered Land Survey No. 237 adjacent to Medicine Lake Estates 3rd Addition was received by the City Council; and WHEREAS, the public hearing with respect to said vacation was held on November 5, 1984 in accordance with the Minnesota Statutes 412.851, as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of November 5, 1984 and WHEREAS, the Council did hold a public hearing on November 5, 1984 to inform any and all interested parties relevant to the vacation of said 28th Avenue North; and WHEREAS, it was determined by the City Council that 28th Avenue North adjacent to Medicine Lake Estates 3rd Addition as described below is not needed for a public street; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA as follows: 1. lbot that part of 28th Avenue North described below is hereby vacated: That part of 28th Avenue North lying northerly of the following described line: Beginning at a point on the Bast line of the West 110.00 feet of Tract F, Registered Land Survey No. 237, files of the Registrar of Titles, in and for Hennepin County, Minnesota, 10.00 feet North of the South line of said Tract F; thence Southwesterly to a point on the East line of Tract D of said Registered Land Survey No. 237 distant 50.00 feet North of the Southeast corner of said Tract D, and said line there terminating. ;resolution No. 84- 772 Page Two 2. That said vacation shay) not affect the authority of any person, corporation or municipality owning or controlling the electric or telephone poles and lines, gas and sewer lines, or water lines, mains and hydrants thereon or thereunder, to continue maintaining the same,, or to enter upon such way or portion thereof vacated to repair, replace, remove otherwise attend thereto. 3. That the City of Plymouth reserves easement rights for utility purpose over and across said vacated street. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Schneider , and upon vote being taken thereon, the following voted in favor thereof: Acting Mayor Schneider, Councilmembers Neils end Crgin e following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted. a ,
