. Pursuant to due call and notice thereof, a special meeting of the City Council of
the City of Plymouth, Minnesota, was held on the 22nd day of October . 1984.
The following members were present: Acting Mayor Schneider, Counci m� embers Roen,
Neils and Crain
The following members were absent: Mayor Davenport
Councilmember Neils introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 84-759
DECLARING FINDING OF NO NEED FOR AN ENVIRONMENTAL IMPACT STATEMENT (EIS) BASED UPON THE
REVIEW OF THE ENVIRONMENTAL ASSESSMENT WORKSHEET (EAW) DATED AUGUST 17, 1984 FOR
CENTRAL PARK APARTMENTS PROPOSED BY TIPTON CORPORATION (82049)
WHEREAS, the City Council approved the RPUD Preliminary Plat/Plan, Conditional Use Per-
mit for Central Park Apartments by Resolution No. 84-514 on August 6, 1984; and,
WHEREAS, pursuant to Minnesota Environmental Quality Board (EQB) Rule No. 6 MCAR
S-3.038- t2 -R1- 02, the Environmental Review Process, the City of Plymouth, as the
responsible governmental unit, submitted an Environmental Assessment Worksheet (EAW)
for the development on August 17, 1984; and,
WHEREAS, the 30 -day review comment period expired on October 10, 1984, and all comments
and recommendations received from reviewing agencies and other interested parties have
been considered; and,
WHEREAS, it has been determined that the proposed development does not present a poten-
tial for significant environmental effects;
NOW, THERFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN-
NESOTA, that it should and hereby does make a negative declaration on the need for an
Environmental Impact Statement (EIS) for the proposed development known as Central Park
Apartments for Tipton Corporation, subject to the following which shall be made part of
the Final Plat and Plan approval:
1. The petitioner shall conduct a noise assessment, as outlined by the Minnesota Pol-
lution Control Agency, and as approved by the City Engineer; if the result of such
noise assessment indicates that mitigating or abortive measures are needed, then
such measures shall be undertaken by the developer, and no Building Permits shall
be issued until such measures are completed and approved by the City Engineer.
2. All disturbed areas of Plymouth Creek shall be revegetated to prevent soil erosion
and provide wildlife cover.
The motion for adoption of the foregoing Resolution was duly seconded by
Councilmember Moen , ead upon vote being taken thereon, the
following voted in favor thereof: Acting Mayor Schneider, Councilmembers Moen,
Neils and Crain
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
