The following membSchneider, ers were present: Acting Mayor Coun— mem ers Moen, Neils and Crain The following members were absent: Mayor Davenport Councilmember Neils introduced the following Resolution and moved its adoption: RESOLUTION NO. 84- 757 AUTHORIZING AGREEMENT WITH THE CITY OF MINNEAPOLIS REGARDING PREPARATION OF, AND PAY- MENT FOR PAR'tERS LAKE NORTH MPUD ENVIRONMENTAL IMPACT STATEMENT (EIS) (82066) WHEREAS, pursuant to Minnesota Environmental Quality Board (EQB) Rule No. 6 MCAR 3.039 J. 1. c., and Rule No. 6 MCAR S 3.039 M. 1. c., the Environmental Review Process, the City of Plymouth is designated the Responsible Governmental Unit for the preparation of the Environmental Impact Statement for the project known as Parkers Lake Planned Devel- opment/Parkers Lake North MPUD proposed by the City of Minneapolis; and, WHER►AS, the required Scoping Decision was established under Resolution No. 84-501; and, WHEREAS, the City has continued the EIS Process by defining the remaining work, and by establishing costs for that work; and, WHEREAS, the costs of the preparation and submittal of the required EIS are to be borne by the project proposer, the City of Minneapolis; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does authorize the Mayor and City Manager to execute an Agreement with the City of Minneapolis, establishing the following regarding the payment of .costs for the preparation and submittal of the required EIS for the Parkers Lake Planned Development/Parkers Lake North MPUD: 1. Costs billed to the City by approved retained consultants, and paid by the City of Plymouth shall be paid in full by the City of Minneapolis; 2. Costs to be paid by the City of Minneapolis shall include an amount equal to 3% of the approved consultant's costs for City of Plymouth administration of the EIS preparation and submittal; 3. The City of Minneapolis shall pay those additional costs which are mutually approved in advance as required for the preparation and submittal of the EIS in excess of the initial approved consultant's contract, including direct time and expense charges by the City of Plymouth staff for preparation of approved tasks related to the required EIS, other than normal administrative distribution expenses. 4. A payment schedule shall be established and may be patterned after the schedule outlined in the State EQB Regulations. The motion for adoption of the foregoing Resolution was duly seconded by * Cguncilmember Moen , and upon vote being taken thereon, the ifoliowing voted in ravor thereof _Acting Mayor Schneider, Councilmembers Moen, Neils and Crain The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
