HomeMy WebLinkAboutCity Council Resolution 1984-729CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 15th day of October . 1%4. The following members were present: Mayor Davenport, Councilmen, bers Poen, Neils, Schneider and Crain The following members were absent: none Councilmember Schneider introduced the following Resolution and moved its adoption: RESOLUTION NO. 84- 729 APPROVING PRELIMINARY PLAT AND VARIANCES FOR GLEN ECHO PONDS 2ND ADDITION FOR RICHARD L. DEMPSEY (84066) WHEREAS, Richard L. Dempsey has requested approval of a Preliminary Plat and Vari- ances for the 11 single family lot subdivision on 3.4 acres located south of 15th Avenue North and east and west of Sycamore Lane; and, WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Preliminary Plat and Variances for Richard L. Dempsey for the division of approximately 3.4 acres for 11 single fam- ily residential lots located south of 15th Avenue North and east and west of Sycamore Lane, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all dead or dying trees from the property at the owner's expense. 3. No Building Permits shall be issued until a contract has been awarded for sewer and water. 4. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of filing the Final Plat. 5. Street names shall comply with the City Street Naming System. 6. No Building Permits shall be issued until the Final Plat is filed and recorded with Hennepin County. 7. The approved Variances include minimum lot size of 11,440 sq. ft.; minimum lot width of 85 ft.; minimum front yard setback of 25 ft.; minimum rear yard setback of 20 ft.; and, minimum side yard setback of 10 ft. based on a finding that the Ordinance Variance Criteria are satisfied, especially with respect to unique- ness, and that the resulting development is consistent with the area design and density. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Moen *and upon vote being taken thereon, the following voted in favor thereof: 73yor Uavenport, Councilmembers Moen, Peels, Schneider and Crain The foilowing voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
