HomeMy WebLinkAboutCity Council Resolution 1984-7030CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 1st day of October 1984. The following members were present: Mayor Davenport, Councilmembers Neils, Schneider and Crain The following members were absent: Counci member Moen Councilmember Neils introduced the following Resolution and moved its adoption: RESOLUTION NO. 84- 703 , APPROVING SITE PLAN, VARIANCES AND CONDITIONAL USE PERMIT FOR MID CO TV SYSTEMS (84074) WHEREAS, Mid Co TV Systems has requested approval of a Conditional Use Permit Site Plan, and Variances for the construction of ars approximate 4300 sq. ft. office facil- ity on property located southeast of 35th Avenue North and Kilmer Lane; and WHEREAS, the Plann+.ng Commission has reviewed said request at a duly called Public Hearing and recomme,ids approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for Mid Co TV Systems for a Conditional Use Permit, Site Plan, and Variaroes for the construction of an approximate 4300 sq. ft. office facility on property located southeast of 35th Avenue North and Kilmer Lane, subject to the following conditions: 1. Compliance with City Engineer's Memorandum. 2. Payment of park dedication fees -in -lieu of dedication in accordance with Dedi- cation Policy in effect at the time of Building Permit issuance. 3. Submission of required financial guarantee and performance agreement for comple- tion of site improvements. 4. Any signage shall be in compliance with the Ordinance. 5. Any subsequent phases or expansions are subject to required reviews and approv- als per Ordinance provisions. 6. All waste and waste containers shall be stored within the structure. 7. The permit is subject to all applicable codes, regulations and Ordinances and violation thereof shall be grounds for revocation. 8. The permit is issued to the petitioner/ tenant as operator of the facility and shall not be transferable. PLEASE SEE PAGE TWO Page two Resolution No. 84- 703 9. The site shall be maintained in a sanitary manner. 10. There shall be no outside display sales or storage of merchandise or related materials other than 2 service vans and one trailer. 11. The permit shall be renewed in one (1) year to assure compliance with the conditions. 12. Variances approved include: side yard parking setback (14.5 vs. 20); rear yard building setback (13 vs. 25) and waiver of fire lane requirement on south side of building. The notion for adoption of the foregoing Resolution was duly seconded by Councilmember Crain , and upon vote being taken thereon, the following voted in favor thereof: Mayor Davenport, Councilmembers Neils., Schneider and Crain The following voted against or abstained: none •hereupon the Resolution was declared duly passed and adopted.
