HomeMy WebLinkAboutCity Council Resolution 1984-700CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 1st day of October 1984. The following members were present: Manor Davenport. Councilmembers Neils, Schneider and Crain The following members were absent: Councilmember oEn f.t Councilmember Neils introduced the following Resolution and moved its adopt -ton: RESOLUTION NO. 84- 700 APPROVING VARIANCES FROM THE SUBDIVISION CODE FOR DIVISION OF EXISTING PLATTED LOT FOR JOHN AND CONSTANCE MORRIS (84077) WHEREAS, Sohn and Constance Morris have requested approval of Variances from the Sub- division Code for the division of an existing platted lot located at 18135 13th Avenue North; and, WHEREAS, the Planning Commission has considered the application and recorsnends approv- al; and, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the Variances from the Subdivision Code for division of existing platted lots for Sohn and Constance Morris for property located at 18135 13th Avenue North as follows: EXISTING LEGAL DESCRIPTION Lot 3, Block 1, PINECREST SECOND ADDITION, according to the plat of record and on file In the office of the County Recorder, Hennepin County, Minnesota. PARCEL A: That part of Lot 3, Block 1, PINECREST SECOND ADDITION according to the plat of record and on file in the office of the County Recorder, Hennepin County, Min- nesota lying Westerly of the following described line: Commencing at the most northwesterly corner of said Lot 3; thence on an assumed bearing of East along the North line of said Lot 3, a distance of 182..54 feet to the point of beginning of the line to be described; thence South 23 degrees 33 minutes 36 seconds East a distance of 308.69 feet to a point on the South line of said Lot 3, distant 120.00 feet East of the most Southwesterly corner of said Lot 3 and there terminating. Subject to an easement for ingress and egress over the North 30.00 feet of the above described land. PARCEL B: That part of Lot 3, Block 1, PINECREST SECOND ADDITION, according to the plat of record and on file in the office of the bounty Recorder, Hennepin County, Min- nesota lying Easterly of the following described line: PLEASE SEE PACE TWO •Page two Resolution No. 84- 700 Commencing at the most Northwesterly corner of said Lot 3; thence on an assumed bearing of East along the North line at said Lot 3 a distance of 182.54 feet to the point of beginning of the line to be described; thence South 23 degrees 33 minutes 36 seconds East a distance of 308.61 feet to a point on the South line of said Lot 3, distant 120.00 feet East of the most Southwesterly corner of said Lot 3 and there terminating. Together with an easement for ingress and egress over the North 30.00 feet of Parcel "A". FURTHER, that the City Manager be authorized to make the necessary special assessment corrections based upon City Policy when the division is approved by Hennepin County. FURTHER, the approved Variances include a lot width of 40 ft. versus 110 ft., and creation of a lot without frontage on a public road, based upon the finding that the Subdivision Code Variance Criteria have been satisfied. The motion for adoption of the foregoinq Resolution was duly seconded by Councilmember Crain , and upon vote being taken thereon, the following voted in favor thereof: Mayor Davenport. Councilmembers Neils, Schneider and Crain The following voted against or abstained: nong •hereupon the Resolution was declared duly passed and adopted.
