. Pursuant to due call and notice thereof, a regular sleeting of the City Council of
the City of Plymouth, Minnesota, was held on the1st_ day of October
The following members were present: Mayor Davenport, Councilmembers Neils.

The following members were absent: Counci member Moen
Councilmember Neils introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 84- 638
APPROVING VARIANCE FROM THE SUBDIVISION CODE FOR LOT DIVISION FOR JACK TAYLOR FOR PROP-
ERTY LOCATED LAST OF VICKSBURG LANE IN THE SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER
OF SECTION 4, 5550 VICKSBURG LANE NORTH (84071)
WHEREAS, Jack Taylor has requested approval of Variance from the Subdivision Code to
divide a 30 acre parcel into 5 acre and 15 acre parcels located east of Vicksburg Lane
In the Southwest Quarter of the Southwest Quarter of Section 5, 5550 Vicksburg Lane
North by metes and bounds description rather than by platting; and,
WHEREAS, the Planning Commission has considered the application;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN-
NESOTA, that it should and hereby does approve the variance to permit the division of
10 land as more specifically described as follows:
EXISTING LEGAL DESCRIPTION
The Southwest quarter of the Southwest quarter of Section 4, Township 118, Range 22,
Hennepin County, Minnesota. Subject to an easement over the Southerly 33 feet thereof
and the Westerly 33 feet and the Easterly 30 feet thereof for public road purposes, ex-
cept the Southwest quarter of the Southwest quarter of the Southwest quarter thereof.
PARCEL A:
The North half of the Northwest quarter of the Southwest quarter of the Southwest
quarter of Section 4, Township 118, Range 22, Hennepin County, Minnesota. Subject
to easement over the westerly 33 feet thereof for public road purposes.
PARCEL B:
The Southwest quarter of the Southwest quarter of Section 4, Township 118, Range
22, Hennepin County, Minnesota except the two following described tracts of land.
1. The North half of the Northwest quarter of the Southwest quarter of the
Southwest quarter of said Section 4.
2. The Southwest quarter of the Southwest quarter of the Southwest quarter of
said Section 4.
' Subject to an easement over the Southerly 33 feet thereof, the most Westerly 33
feet thereof and the Easterly 30 feet thereof for public road purposes.

FURTHER, that the City Manager be authorized to make the necessary special assessment
corrections based upon City Policy when the division is approved by Hennepin County,
AND,
FURTHER, the Variance is based upon the following:
1. There are special circumstances and conditions affecting the specific property
such that the strict application of the provisions of the Code would deprive the
applicant of the reasonable use of the land.
2. That the Variance /s necessary for the preservation and enjoyment of a substantial
property rich* or the applicant.
3. The granting of the Variance will not be detrimental to the public welfare or
injurious to other property in the territory in which the property is situated.
4. The petitioner will file a perpetual covenant on the property restricting any
further subdivision of the land.
The motion for adoption of the foregoing Resolution was duly seconded by
Councilmember Crain , and upon vote being taken thereon, the
