Pursuant to due call and notice thereof, a special meeting of the City
Council of the City of Plymouth, Minnesota was held on the 24th day of
September , 1984. The following members were present: Ty—or Davenport,
Councilmembers Moen, Neils, Schneider and Crain The following members were
absent: none
Councilmember Neils introduced the following Resolution and moved its
adoption:

ADOPTING ASSESSMENTS
PROJECT 123
POND BC-Pll
WHEREAS, pursuant to proper notice duly given as required by law, the Council
has met and heard and passed upon all objections to the proposed assessments
for the improvements of:
1. The structure necessary to impound water in Pond BC-Pll lying
East of County Road ol, South of 30th Avenue and North of
28th Avenue
2. Channel dredging between Pond BC-Pll and County Road 61
by the installation of storm sewer, ponding areas, outlet control structure,
channel cleanout and all necessary appurtenances;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
as amended,
1. Such proposed assessment,/a copy of which is attached hereto and made a
part hereof, is hereby accepted and shall constitute the special assess-
ment against the lands named therein and each tract of land therein
included is hereby found to be benefited by the proposed improvement in
the amount of the assessment levied against it.
2. Such assessment shall be payable in equal annual installments extending
over a period of 5 years, the first of the installments to be payable on
or before the first Monday in January 1985, and shall bear interest at the
rate of 10.33% per annum from the date of adoption of this assessment reso-
lution. To the first installment shall be added interest on the entire
assessment from the date of this Resolution until December 31, 1985. To
each subsequent installment when due shall be added interest for one year
on all unpaid installments.
3. The owner of any property so assessed may, at any time prior to certifica-
tion of the assessment to the County Finance Director, pay the whole of
the assessment on such property with interest accrued to the date of pay-
ment to the City Finance Director, except that no interest shall be
charged if the entire assessment is paid within 30 days from the adoption
of this Resolution; and he may at any time thereafter pay the City Finance
Director the entire amount of the assessment remaining unpaid with
interest accrued to December 31 of the year in which such payment is made.

' 4. The clerk shall forthwith transmit a certified duplicate of this
assessment to the County Finance Director to be extended on the proper tax
lists of the County and such assessments shall be collected and paid over
in the same manner as other municipal taxes.
5. The total cost of the improvement assessed by this Resolution is:
$116,834.42
The motion for the adoption of the foregoing Resolution was duly seconded by
_Councilmember Crain , and upon vote being taken chereon, the
following voted in favor thereof: Mayor Davenport, Councilmembers Moen, Neils,
Schneider and Crain
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
