HomeMy WebLinkAboutCity Council Resolution 1984-676CITY OF PLYMOUTH Pursuant to due call and notice thereof, a special meeting of the City Council of the City of Plymouth, Minnesota was held on the 24th day of September , 1984. The following members were present: Mayor Davenport, Councilnember Moen, Neils, Schneider and Crain The following members were absent: none Councilmember Neils. introduced the following Resolution and moved its adoption: RESOLUTION NO. 84- 676 ADOPTING ASSESSMENTS PROJECT 231 6TH AVENUE/HUMPHREY ESTATES WHEREAS, pursuant to proper notice duly given as required by law, the Council has met and heard and passed upon all objections to the proposed assessments for the improvements of 6th Avenue from a point 696 ft. M.O.L. East of the centerline of Xenium Lane to Pineview Lane and Sycamore Lane and Sycamore Circle within the proposed Humphrey Estates Addition by the installation of sanitary sewer and watermain laterals, storm sewer, bituminous street with concrete curb and gutter, and all necessary appurtenances; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assess- ment against the lands named therein and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of 15 years, the first of the installments to be payable on or before the first Monday in January 1985, and shall bear interest at the rate of 9.17% per annum from the date of adoption of this assessment reso- lution. To the first installment shall be added interest on the entire assessment from the date of this Resolution until December 31, 1985. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. The owner of any property so assesseu may, at any time prior to certifica- tion of the assessment to the County Finance Director, pay the whole of the assessment on such property with interest accrued to the date of pay- ment to the City Finance Director, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this Resolution; and he may at any time thereafter pay the City Finance Director the entire amount of the assessment remaining unpaid with interest accrued to December 31 of the year in which such payment is made. 4. The Clerk shall forthwith transmit a certified duplicate of this assess- ment to the County Finance Director to be extended on the proper tax lists of the County and such assessments shall be collected and paid over in the same manner as other municipal taxes. The total cost of the improvement assessed by this Resolution is: Street, curb and gutter, storm sewer $15,860.22 Watermain 2,333.84 $18,194.06 The motion for the adoption of the foregoing Resolution was duly seconded by . Councilmember Moen , and upon vote being taken thereon, the following voted in favor thereof: Mayor Davenport, Councilmembers Moen, Neils, Schneider and Crain The following voted against or abstained: none Whereuvon the Resolution was declared duly passed and adopted.
