HomeMy WebLinkAboutCity Council Resolution 1984-655CITY OF PLYMOUTH Pursuant to due call and notice thereof, a re4;ul ar meeting of the City Council of the City of Plymouth, Minnesota, was held on the 17th day of September . 1984. The following members were present: NTayor Daven��or=, ouncilmem ers ,,.oen, — Neils, Schneider and Crain The following members were absent: none Councilmember Neils adoption: introduced the following Resolution and moved its RESOLUTION NO. 84- 655 APPROVING APPEAL BY KENNETH L. BOWERS OF BOARD OF ZONING ADJUSTMENTS AND APPEALS RULING WHEREAS, Kenneth L. Bowers, pursuant to Section 11, Subdivision C of the Plymouth Zon- ing Ordinance, has appealed the September 10, 1984 ruling of the Board of Zoning Ad- justments and Appeals relative to his request for a variance at 2515 Quinwood Lane, also described as Lot 20, Block 5, PLYMOUTH CREEKVIEW ADDITION; and, Wr1EREAS, the petitioner has requested a variance of 3 ft. from the Ordinance maximum 3 ft., to construct a 6 -ft. high fence in the required front yard of his property around his newly constructed swimming pool; and, WHEREAS, the Board of Zoning Adjustments and Appeals considered the matter on September 10, 1984 at which time the ruling was made to deny the variance request as submitted; and, WHEREAS, the City Council has reviewed the proceedings of the Board of Zoning Adjust- ments and Appeals, as well as the petitioner's application for the variance and for the Appeal; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the Appeal by Kenneth L. Bowers from the Board of Zoning Adjustments and Appeals ruling, and does hereby approve a 6 ft. high fence as requested, subject to the following: 1. The Variance is approved based upon the finding that the petitioner has satisfied the Ordinance standards for granting variances. 2. The Variance is granted to allow the fence to be constructed in the location re- flected on the plan in the Staff Report dated September 10, 1984. 3. No other variances are granted or implied by this action. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Schneider , and upon vote being taken thereon, the following voted In favor thereof: 1,s4ayor ayenport, Councilme;ibers Moen, Neils, Schneider and Crain The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
