HomeMy WebLinkAboutCity Council Resolution 1984-644CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 17th day of September . 1984. The following members were present: Mayor Davenport 5uncilmembers Moen, ie s, Schneider and Crain The following members were absent: none Councilmember Schneider introduced the following Resolution and moved its adoption: RESOLUTION NO. 84- 644 APPROVING PRELIMINARY PLAT FOR JEROME JUELICH, PINEVIEW, INCORPORATED FOR MEDICINE LAKE ESTATES 3RD ADDITION (81068) WHEREAS, Jerome Juelich, Pineview, Inc. requests requests approval of a Preliminary Plat for five single family residential lots on property located east of Medicine Lake Drive and north of 28th Avenue North; and, WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HERESY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Preliminary Plat for Jerome 10 Juelich, Pineview Inc., for Medicine Lake Estates 3rd Addition consisting of five single family residential lots located east of Medicine Lake Drive and north of 28th Avenue North, subject to the following: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all dead or dying trees from the property at the owner's, expense. 3. No Building Permits shall be issued until a contract has been awarded for munic- ipal sewer and water. 4. Provisions for a 30 -ft. wide trail outlot per Comprehensive Park Plan, as veri- fied by the Parks and Engineering Departments, with submittal of detailed plans as to construction of the trail per City standards. S. Payment of park dedinAlon fees-in-1+eu of dedication with appropriate credits in an amount aetermined according to verified acreage and paving costs and ac- cording to the Dedication Policy in effect at the time of filing the Final Plat. 6. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 7. No Building Permits shall be issued until the Final Plat is filed avid recorded with Hennepin County. 8. Yard setbacks shall be per R -1A Zoning District standards. PLEASE SEE PAGE TWO Page two Resolution No. 84- 644 9. Lots 1 and 2 shall have access to CSAH 154 via a shared drive at, or near the common property line. Appropriate language and covenants for the shared drive shail be approved by the City Attorney, and filed with the Final Plat at Hennepin County. 10. Lot 3 shall provide private drive access to 28th Avenue North. 1:. If the anticipated vacated right-of-way for 28th Avenue North cannot be obtained by the petitioner, proposed Lot 5 shall be incorporated as part of Lot 4 on the final plat for filing the Final Plat at Hen�pepin County. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Moen and upon vote being taken *hereon, the following voted in favor thereof: Magor Davenport, Councilmembers Moen, Neils, Schneider and Crain The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
