HomeMy WebLinkAboutCity Council Resolution 1984-635CITY OF PLYMOUTH Pursuant to due call and notice thereof, a reaular meeting of the City Council of the City of Plymouth, Minnesota was held on the 17th day Of— Senfemher 1984. The following members were present: Mayor Davenport, CouncQmPmhers Moen. Neils. Schneider and Crain The following members were absent: none CounciImp m' or Moon introduced the following Resolution and moved its adoption: RESOLUTION NO. 84- 635 DENYING THE VACATION OF UTILITY AND DRAINAGE EASEMENTS CIRCLE STAR BUSINESS CENTER 1ST ADDITION WHEREAS, the petition to vacate certain drainage and utility easements in the Circle Star Business Center ler Addition was received by the City Council; and WHEREAS, the public hearing with respect to said vacation was held on September 17, 1984 in accordance with Minnesota Statutes 412.851 as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of September 17, 1984; and WHEREAS, the Council did hold a public hearing on September 17, 1984 to inform any and all interested parties relative to the vacation of said easement; and WHEREAS, it was determined by the City Council that said easement ahould not be vacated at this time; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH as follows: That the following described drainage and utility easements shall not be vacated at this time A nonexclusive easement for utility and drainge easement for utility and drainage purposes over, under, across and through the East 30' of Lots 3 and 11, Block 2, Circle Star Business Center 1st Addition, Files of the Registrar of Titles, Hennepin County, Minnesota. Said easement is recorded as Document No. 1144505; and utility and drain- age easements as show.i and dedicated on each side of the lot line dividing Lots 3 and 11, on each side of the lot line dividing Lots 4 and 10, except the East 11.25' of said lots, Block 2, Circle Star Business Center let Addition, files of the Registrar of Titles, Hennepin County, Minnesota. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Neils , and upon vote being taken thereon, the following voted in favor thereof: _Mayor Davenport, Councilmembers Moen, Neils, Schneider and Crain The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
