Luincilmember Schneider introduced the following Resolution and moved

RESOLUTION NO. 84- 613
DECLARING SURPLUS PROPERTY AND AUTHORIZING CONVEYANCE TO
ADJACENT PROPERTY OWNERS
WHEREAS, the City of Plymouth had undertaken the improvement of T.H. 101 and
C.S.A.H. 6, SP 155-010-01 and SP 27-606-04, City Project No. 506; and
WHEREAS, it was necessary to obtain certain easements to facilitate said
project and an easement was required from Mr. Herbert Johnson at the southeast
corner of T.H. 101 and C.S.A.H. 6; and
WHEREAS, Mr. Johnson was desirous of obtaining certain right-of-way of C.S.A.H.
6 adjacent to his property, said right-of-wpv not being necessary for public
purposes upon completion of Project No. 506; ind
WHEREAS, the City and the property owner reached an agreement for the necessary
easements and right-of-way; and
WHEREAS, as part of this agreement the City would acquire for the property
owner the right-of-way not being required for public purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH that the following described property is declared surplus property and
the Mayor is authorized to execute a quit claim deed cotimveying this property to
Herbert A. and Laura Johnson:
All that part of the right-of-way of old County State Aid Highway No. 6 lying
within the Southwest 1/4 of the of the Southwest 1/4 of Section 29, Township
118, Range 22 which lies north of the south line of said road as shown in
County State Aid Highway No. 6, Plat 5 (on file in the office of the County
Recorder), south of a line drawn parallel with and distant 60 feet south of the
the survey line of said plat and easterly of a line drawn southwesterly at an
angle of 50° with said 60 foot parallel line from a point thereon distant 88
feet east of its intersection with the west line of said section, and lying
west of the following described line: Beginning at the Northwest corner of
Plymouth Square, as platted in Hennepin County, thence North on a bearing of N
0° 5' 17" E to the intersection of the centerline of County State Aid Highway
No. 6 and there terminating.
BE IT FURTHER RESOLVED that the following described property is declared
surplus property and the Mayor is authorized to execute a quit claim deed
conveying this property to Theis and Talle Enterprises, Inc.:
All that part of the right-of-way of old County State Aid Highway No. 6 lying
within the Southwest 1/4 of the Southwest 1/4 of Section 29, Township 118,
Range 22, which lies north of the south line of said road as shown in County
State Aid Highway No. 6, Plat 5 (on file in the office of the County Recorder),

The motion for the adoption of the foregoing Resolution was duly seconded by

Whereupon the Resolution was declared duly passed and adopted.
