HomeMy WebLinkAboutCity Council Resolution 1984-555Cm NF PLVNI M Pursuant to dam call and notice tMrMf, ar r wasting of the City Council of the City of PlyaoutA, Mneewta, was held on t day of August 1984 The following .eters were presents Payor Davenport, cunei lmembers Mben,, NO is, Schneider and Crain follow"The mmmemm+eabowts none Councilmember Schneider introduced the following Resolution and mored its adoption: RESOLUTION NO. 84- 555 APPROVAL OF COIPREFENSIVE PLAN AMENDMENT - STAGED DEVELOPMENT PLAN FOR THE CITY OF PLYMOUTH WHEREAS, the City of Plymouth has requested approval of an Amendment to the Compre- hensive Plan - Staged Development Plan for properties located in Sewer District NW -21 in the Northeast Quarter of the Northwest Quarter of Section 18, and Sewer District NC -9 in the Northeast Quarter of the Southwest Quarter of Section 10, to be removed from the Post -1990 Urban Service Area; and, WHEREAS, that land located in Sewer District NC -9 in the Northeast Quarter of the Southwest Quarter in Section 10 (Area 2, as identified on Exhibit A) is bisected by the Post -1990 Urban Service Area boundary and the property can be serviced with sani- tary sewer without the extension of trunk sewer lines and are failing; and the Metro- politan Waste Control Commission by agreement with the City of Plymouth has provided an interceptor sewer which can serve this area; and, . WHEREAS, that property located in Sewer District NW -21 in the Northeast Quarter of the Northwest Quarter of Section 1S (Area 1, as shown on Exhibit A) was developed with private septic systems which have deteriorated; and, WHEREAS, the Planning Commission has considered the request following a duly schedul- ed Public Hearing and has recommended approval; and, WHEREAS, this Amendment by the City is to assure that adherence to the Comprehensive Plan - Staged Development Plan in the City is consistent, as required by State law and City Ordinance; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Amendment to the Comprehensive Plan - Staged Development Plan subject to the following: 1. The Amendment is based upon the findings that the proposed designation of the properties to be located within the Metropolitan Urban Service Area is consis- tent with the Comprehensive Plan and Ordinance provisions; resolves the current sanitation problem with the failing septic systems in an existing plat; allows the development of property that can be serviced without the extension of trunk sewer lines; and, the proposal would not adversely impact the City's Land Use Plans. 2. Approval is contingent upon, and subject to the required review and response by the Metropolitan Council. The notion for adoption of the foregoing Resolution was duly seconded by Councilmember Moen and upon vote being taken thereon, the o voted In favor thereaft, ayor NjefnRort, Council_members Moen, Neils, Schneider and Crain o lowing voted against or a none Whereupon the Resolution was declared duly passed and adopted.
