Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota was held on the 6th day
of August , 1984. The following members were preseM. mayor Davenport,
_ Councilmembers Moen, Niels, Schneider and Crain
The following members were absent: none
Councilmember Moen introduced the following Resolution and moved
its adop[ on:
RESOLUTION N0. 84- 535
AUTHORIZING CONDEMNATION PROCEEDINGS
PROJECT NO. 129 - COUNTY ROAD 15/I-494 INTERCHANGE
WHEREAS, the City of Plymouth has undertaken Project No. 129; and
WHEREAS, in order to construct the improvements certain permanent easements are
required; and
WHEREAS, the City Council finds it necessary, proper and expedient in the
interests of the public health, convenience and general welfare of the citizens
of the City of Plymouth for the City to acquire said easements;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, Minnesota, that the City Attorney is hereby authorized to commence
condemnation proceeds for Project No. 129 for the following described easements
within the following described parcel:
DESCRIPTION OF PARCEL:
10 All that part of the West 247 feet of the following described property lying
North of the South 820 feet thereof: Commencing at a point 446.74 feet East of
the Southwest corner of the Southeast 1/4 of the Southeast 1/4 of Section 33,
Township 118 North, Range 22 West; thence North parallel with the West line of
said Southeast 1/4 of the Southeast 1/4 a distance of 1066.92 feet to the
center of County Road; thence Northeasterly along the centerline of said County
Road 415.99 feet; thence South parallel with the West line of said Southeast
1/4 of the Southeast 1/4, a distance of 1238.67 feet to the section line;
thence West 378.14 feet to beginning.
DESCRIPTION OF EASEMENT:
A perpetual easement for public right-of-way purposes over, under and across
that part of the above described parcel which lies Northerly of the following
described line: Commencing at the Southeast corner of the above described
property; thence North 0 degrees 03 minutes 20 seconds East, assumed bearing,
along the East line of said above described land a distance of 288.32 feet to
the point of beginning of the line to be described; thence Westerly a distance
of 101.75 feet along a non-tangential curve having a central angle of 27
degrees 13 minutes 42 seconds, a radius of 214.11 feet and a chord bearing of
South 82 degrees 22 minutes 33 seconds West; thence South 66 degrees 01 minutes
16 seconds West a distance of 161.07 feet to the West line of the above
desceribed land and said line terminating.
The notion for the adoption of the foregoing Resolution was duly seconded by
Council member Crain , and upon vote being taken thereon, the
following voted in favor thereof: Mayor Davenport, Councilmembers Moen, Neils,
Schneider and Crain
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
