Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota was held on the '6th day of
August , 1984. The following members were present: Mayor Davenport,
Councllmembers Moen, Neils, Schneider and Crain
The following members were absent: none ,
Councilmember Moen introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 84- 533
ACCEPTING PETITION FOR UTILITY IMPROVEMENTS
PROPOSED DEERWOOD TRAILS ADDITION
PROJECT NO. 412
WHEREAS, the developer of Zachary Hills 3rd and 4th Addition has petitioned
the City to install a 7 ton bituminous street with concrete curb and gutter,
drainage facilities, sanitary sewer and watermain and all necessary
appurtenances; and
WHEREAS, property benefited by such improvements will be assessed for all or a
portion of the costs of such improvements pursuant to Minnesota Statutes
429.011 to 429.111 (Laws 1953, Chapter 398 as amended); and
WHEREAS, Resolution No. 84-292 as adopted by the City Council on May 7, 1984
wherein the proposed improvements for Zachary Hills 3rd Addition and 4th
Addition were ordered and final plans and specifications were ordered; and
WHEREAS, the owner -if proposed Deerwood Trails Addition (PIN
11-118-22-42-0001), legally described as the West 660 feet of the North 1/2 of
the South 1/2 of the Northwest 1/4 of the Southeast 1/4 of Section 11, has
petitioned the City Council for the installation of sanitary sewer and
watermain with services for Lots 1 through 7, Block 1 of proposed Deerwood
Trails preliminary plat; and
WHEREAS, the developer has waived his right to public improvement hearings and
special assessment hearings on said improvements;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH:
1. That the petition submitted by Edward T. Johnston is hereby accepted
by the City Council.
2. That Edward T. Johnston has granted the City of Plymouth an easement
for the construction of sanitary sewer across his property, described
as 11-118-22-42-0001.
3. That the total assessment for said parcel which would provide service
to Lots 1 through 7, Block 1, proposed Deerwood Trails Addition would
not exceed $3500 per lot or $24,500 total; and
4. The assessments would not be levied until 1987, or until the plat is
filed and the assessments divided among Lots 1 through 7, Block 1,
Deerwood Trails Addition, with interest to begin at the time the
assessment is levied.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Crain , and upon vote being taken thereon, the
following voted in favor thereof: Mayor Davenport, Councilmembers Moen, Neils,
Schneider and Crain
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
