Pursuant to due call and notice thereof, a regulrr meeting of the City Council of
the City of Plymouth, Minnesota, mas held on the -btn day of Au ustt . 1184.

Councilmember Schneider introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 84- 523
APPROVING A CONDITIONAL USE PERMIT FOR MILES AND JOAN OTTINGER FOR A HOME OCCUPATION AT
1120 VAGABOND LANE NORTH (84061)
WHEREAS, Miles and Joan Ottinger have requested a Conditional Use Permit for a Home
Occupation to bake and decorate cakes from their residence at 1120 Vagabond Lane; and,
WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does approve the request for Miles and Joan
Ottinger for a Conditional Use Permit for a Home Occupation to bake and decorate cakes
from their residence at 1120 Vagabond Lane, subject to the following conditions:
1. The permit is subject to all applicable codes, regulations and Ordinances, and
violation thereof shall be grounds for revocation.
2. The permit is issued to the petitioner as operator of the facility and shall
not be transferable.
3. The site shall be maintained in a sanitary manner.
4. There shall be no outside display, sales, or storage of merchandise or related
materials.
S. Hours of baking operation shall be limited to 10:00 A.M. to 2:00 P.M. Monday
through Saturday, with no baking related to the conditional use on Sundays.
6. The permit shall be renewed in one year to assure compliance with the
conditions.
7. Approval does not include any on site retail sales of products related to the
Home Occupation; customer pick-up of pre -ordered product is not allowed.
8. The permit shall be issued subsequent to approval of the use by Hennepin
County Health Department, and subsequent to final inspection of the structural
addition by the Building Official.

9. There shall be no signage related to the use.
10. No more than one commercial oven shall be used.
The motion for adoption of the foregoing Resolution was duly seconded by
Councilmember Neils , and upon vote being taken thereon, the
following voted in favor thereof: _Mayor Davenport, Councilme_ mbers,Moen, Neils,
Schneider and Crain
