The following members were presents_ Mayor Davenport, Counciimembers Moen, Nei s, — Schneider and Crain The following members were absent: none Councilmember Crain introduced the following Resolution and moved its adoptions RESOLUTION NO. 84- 522 APPROVING CONDITIONAL USE PERMIT AND SITE PLAN FOR CATES CONSTRUCTION COMPANY FOR GREGG FUNFAR, JOHN TOMBERS AND COLONIAL CORNER, INC. (84044) WHEREAS, Cates Construction Company has requested approval of a Conditional Use Per- mit and Site Plan for the construction of an automotive parts retail store, service center, and a 10 -bay self-service car wash to be located north of State Highway 55 Service Road and west of South Shore Drive; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, - MINNESOTA, that it should and hereby does approve the request for Cates Construction Company for Gregg Funfar, John Tombers and Colonial Corner, Inc. for a Conditional Use Permit and Site Plan to allow the construction of an automotive parts retail store, service center and a 10 -bay self-service car wash to be located north of State Highway 55 Service Road and South Shore Drive, subject to the following: 1. Compliance with City Engineer's Memorandum. 2. Payment of park dedication fees -in -lieu of dedication in accordance with Dedication Policy in effect at the time of Building Permit issuance. 3. Submission of required Site Performance Agreement and financial guarantee for completion of site improvements. 4. The Conditional Use Permit is subject to all applicable codes, regulations and Ordinances and violation thereof shall be grounds for revocation. 5. The site shall be maintained in a sanitary manner. 6. All waste and waste containers shall be stored within approved designated areas as diagrammed on the plans dated May 30, 1984. 7. There shall be no outside display, sales, or storage of merchandise or re- lated materials. PLEASE SEE PAGE TWO Page two Resolution No. 84- 522 8. All signage shall comply with Ordinance standards. 9. The Conditional Use Permit for the service center and car wash shall be subject to renewal one year after issuance. 10. Lighting of the north portion of the site shall be limited to wall mounted fixtures which are directed downward and do not extend beyond the parking area. 11. Any subsequent phases or expansions are subject to the required reviews and approvals per Ordinance provisions. 12. No stacking on the frontage road is allowed; policing of this shall be the responsibility of the car wash management. 13. The hours of operation for the auto service center are: 8:00 A.M. - 8:00 P.M. - Monday through Friday 8:00 A.M. - 5:00 P.M. - Saturday 10:00 A.M. - 4:00 P.M. - Sunday The hours of operation for the carwash are: 7:00 A.M. - 9:00 P.M. - Monday through Saturday 10:00 A.M. - 9:00 P.M. - Sunday 14. An employee will be present at the carwash during all hours of operation. 15. The Spruce trees added for screening on the north side of the site shall be a minimum of 8 ft. in height. 16. Fence posts shall be increased from 4 inches by 4 inches to 6 inches by 6 inches along the northerly property line.
