Pursuant to due call and notice thereof, aregular meetbq of the City Counall of
the City of Plymouth, Minnesota, was held on the 6th day of Au ust 1984.

Councilmember Neils introduced the following wesolutlem amr mals its
adoption:
RESOLUTION NO. 84- 514
APPROVING RESIDENTIAL PLANNED UNIT DEVELOPMENT PRELIMINARY PLAN/PLAT, REZONING, AND
CONDITIONAL USE PERMIT FOR TIPTON CORPORATION (RPUD 84-5)(82049)
WHEREAS, Tipton Corporation has requested approval of a Residential Planned Unit
Development Preliminary Plan/Plat, Rezoning from FRD (future restricted development)
District to R -1A (low density single family residential) District, R-3 (medium den-
sity multiple residence) District, and R-4 (high density multiple residence) Dist-
rict, and a Conditional Use Permit for 13 lots and 1 outlot for the development of
500 apartment units units, 8 single family detached residential units, on property
located west of Fernbrook Lane and along proposed 34th Avenue North, northeasterly of
City Center; and,
WHEREAS, the Planning Commission has reviewed the request at a duly called Public
Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYIpUTN,
MINNESOTA, that it should and hereby does approve the Residential Planned Unit Devel-
opment Preliminary Plan/Plat, and Conditional Use Permit for Tipton Corporation for a
Residential Planned Unit Development to be located west of Fernbrook Lane and along
proposed 34th Avenue North, northeasterly of the City Center, subject to the follow-
ing conditions:
1. Compliance with the City Engineer's Memorandum.
2. Removal of all dead or dying trees from the property at the owner's expense.
3. No Building Permits shall be issued until a Contract has been awarded for
municipal sewer and water.
4. Dedication of a 30 -ft. wide trail corridor per Comprehensive Park Plan, as veri-
fied by the Parks and Engineering Departments, with submittal of detailed plans
as to construction of the trail per City standards.
5. Dedication of Outlots A and B to the City for park, open space and public rec-
reational purposes.
6. Street names shall comply with the City Street Naming System.
7. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations
for new structures in subdivisions adjacent to, or containtng Any open store
water drainage facility.
8. Rezoning shall be finalized with filing of the Final Plat.

b9. Environmental Quality Board EAW procedures shall be initiated upon City Council
approval of the Preliminary Plat/Plan.
10. No Building Permits shall be issued until the Final Plat is filed and recorded
with Hennepin County.
11. Appropriate legal documents such as Homeowner Association or management agree-
ment documents, covenants and restrictions as approved by the City Attorney,
shall be filed with the Final Plat.
12. Staging of the development shall be in accordance with utility availability as
approved by the City Engineer, and agreement as to the costs to be assessed to
the development.
13. Maximum overall density shall be 7.9 units per acre for the land at or above the
established High Water Elevation per the adopted City Storm Water Drainage Plan
as verified by the City Engineer. Six density bonus points are assigned as
follows:
a. Three points are based on the size of the project;
b. One point based on the proposal providing a variety of housing types; and,
C. Two points based on the provisions for effective open. space.
14. The construction of 34th Avenue North between the west property line and Fern -
brook Lane is to be completed with the first phase of the development.
15. A minimum of one underground parking space shall be provided for each dwelling
unit in both LA -3 and LA -4 guided areas, as partial satisfaction of Ordinance
minimum parking requirements.
16. All plats, plans, and development agreements are to conform with this prelimin-
ary plan, and any amendments shall require specific approval by the City
Council.
17. A maximum effort of buffering and berming shall be provided near Lanewood Lane
from the LA -3 area.
18. The PUD Final Plan/Plat application shall be responsive to applicable design
provisions of the Zoning Ordinance regarding multi -family buildings.
19. The PUD Final Plan/Plat application shall reflect the terms of agreement among
Tipton Corporation, Cavanaugh Homeowner's Association, and individual homeowners
as outlined in the text of Mr. Propsma's presentation to the Council dated
August 6, 1984, subject to City approval of the Final Plan/Plat.
The motion for adoption of the foregoing Resolution was duly seconded by
Councilmember Crain and,upon vote being taken thereon, the
of owing voted in favor thereof: Mayor Davenport, Councilmembers Moen, Neils,
Schneider and Crain
