HomeMy WebLinkAboutCity Council Resolution 1984-512CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meting of the City Council of the City of Plywouth, Minnesota, was held on the --6th day of August . 1964. The following members were present: Mayor Davenport,ouncilmembers Moen, Schneider and Crain The following skabers. were absent: none Couqcilmember Neils introduced the following Resolution and moved its adopt on: RESOLUTION NO. 84- 512 APPROVING PRELIMINARY PLAT FOR SCHERER BROTHERS LUMBER COMPANY (84045) WHEREAS, Scherer Brothers Lumber Company has requested approval of a Preliminary Plat for approximately 53 acres to be platted into nine industrial lots, and rezoning from FRD (future restricted development) District to I-1 (planned industrial) District for property located northwest of County_Road 18 and Soo Line Railroad right-of-way; and, WHEREAS, the Planning Commission has reviewed ttie request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve :.he Preliminary Plat for Scherer Brothers Lumber Company for property located northwest of County Road 18 abd Soo Line Railroad right-of-way, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all dead or dying trees from the property at the owner's expense. 3. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of issuance of Building Permit. 4. Provisions for a 30 -ft. wide trail easement on Lot 1, Block 1, per Comprehensive Park Plan, as verified by the Parks and Engineering Departments, with submittal of detailed plans as to construction of the trail per City standards. 5. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 6. Rezoning shall be finalized with filing of the Final Plat. 7. Submittal of the Environmental Assessment Worksheet (EAW) for City review, and processing, to be completed prior to Final Plat approval. 8. No Building Permits shall be issued until the Final Plat is filed and recorded with Hennepin County. PLEASE SEE PAGE TWO Page two . Resolution No. 84- 512 9. No yard setbacks are granted or implied. 10. The final plat application shall not be submitted until approval by the Public Service Commission has been granted for the extension of Nathan Lane, and until the Environmental Assessment Worksheet (EAW) review process is completed. 11. A Site Plan for Lot 1, Block 1 may be submitted for review prior to approval by the Public Service Commission for the extension of Nathan Lane and completion of the Environmental Assessment Worksheet (EAW) process. Approval of a Site Plan shall be contingent upon actual approval of a crossing by the Public Service Commission, upon completion of the EAW review process and filing of the approved Final Plat. 12. Any future owner of Lot 1, Block 1, shall acknowledge in writing understanding of the contingencies with respect to road access at the time of making application for Site Plan Approval.
