HomeMy WebLinkAboutCity Council Resolution 1984-485CITY of PLYNMM Pursuant to due call and notice thereof, a _special meeting of the Board of Zoning Adustments and Appeals of the City of Plymouth,, Minnesota, was held on the 23rd day of July . 1984. The following members were present: Acting Mayor ilmers Schneider. CouncembNeils and Crain The following members were absent: Mayor Davenport an Counciimember Moen _Councilmember Crain introduced the following Resolution and moved its adoption: RESOLUTION NO. 84- 485 APPROVING APPEAL BY FRANK J. KNOUREK OF BOARD OF ZONING ADJUSTMENTS AND APPEALS RULING WHEREAS, Frank J. Knourek pursuant to Section 11, Subdivision C of the Plymouth Zoning Ordinance, has appealed the July 9, 19&: ruling of the Board of Zoning Adjustments and Appeals relative to his request for a variance at 16925 - 11th Avenue North, also described as Lot 1, Block 1, CITYVIEW ACRES SECOND UNIT; and WHEREAS, the petitioner has requested a 1 foot variance from the Ordinance maximum height of 3 feet in the required front yard in order to construct a 4 foot high fence; and, WHEREAS, the Board of Zoning Adjustments and Appeals considered the matter on June 11 and July 9, 1984, at which time the ruling was made to deny the variance request as submitted, and to approve a variance for 6 inches; and, WHEREAS, the City Council has reviewed the proceedings of the Board of Zoning Adjust- ments and Appeals, as well as the petitioner's application for the variance and for the appeal; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the appeal by Frank J. Knourek of the Board of Zoning Adjustments and Appeals ruling, does hereby approve a 1 foot variance as requested, subject to the following: 1. The Variance is approved based upon the finding that the petitioner has satisfied the Ordinance standards for granting variances. 2. The Variance is granted to allow the fence design reflected on the plan in the Staff Report dated June 6, 1984. 3. No other Variances are granted or implied by this action. 4. The petitioner be allowed only one gate accevs for his driveway. 5. The property located outside of the fence shall be maintained. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Neils and upon vote being taken thereon,, the followbig voGa In favor thereof: Actinu Mayor Schneider, Councilmembers Neils and Crain The following voted against or abstained: none Whereupon the Resolution was declared duly passed and ad1opted.
