Pursuant to due call and notice thereof, a special meeting of the Board of Zoning
Adustments and Appeals of the City of•Plymouth,Ilwi�sota, was held on the 23rd

Councilmember Neils introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 84- 484A
APPROVING APPEAL BY HENSON J. SMITH, JR. OF BOARD OF ZONING ADJUSTMENTS AND APPEALS
RULING
WHEREAS, Henson J. Smith, Jr. pursuant to Section 111, Subdivision C of the Plymouth
Zoning Ordinance, has appealed the July 9, 1984 ruling of the Board of Zoning Adjust-
ments and Appeals relative to his request for a variance at 11911- 23rd Avenue North,
also described as Lot 9, Block 1, PENWALK ADDITION; and
WHEREAS, the petitioner has requested a variance of 7 feet from the Ordinance minimum
requirement for 10 feet minimuim setback from the side yard property line to a princi-
pal structure in order to construct a deck onto his home; and,
WHEREAS, the Board of Zoning Adjustments and Appeals considered the matter on June 11
and July 9, 1984, at which time the ruling was made to deny the variance request as
submitted, and to approve a variance for 5 feet; and,
WHEREAS, the City Council has reviewed the proceedings of the Board of Zoning Adjust-
ments and Appeals, as well as the petitioner's application for the variance and for the
appeal;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN-
NESOTA, that it should and hereby does approve the appeal by Henson 3. Smith, 3r. of
the Board of Zoning Adjustments and Appeals ruling, does hereby approve a 7 foot vari-
ance as requested, subject to the following:
1. The Variance is approved based upon the finding that the petitioner has satisfied
the Ordinance standards for granting variances.
2. The Variance is granted to allow the addition design reflected on the plan in the
Staff Report dated June 28, 1984.
3. No other Variances are granted or implied by this action.
4. The Variance is approved subject to granting the A ft. drainage and utility ease-
ment on the west property line, and a release clause to be filed on the property
holding the City harmless if any portion of the deck needs to be removed in order
to use the easement.
