Pursuant to due call and notice thereof, a special meeting of the City Council of
the City of Plymouth, Minnesota, was held on the 9th day of July 1984.
The following members were present: Mayor Davenport. Councilmembers Neils,
Schneider and Crain
following i,s were absent: Councilmember Moen
Councilmember Neils introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 84-452
APPROVING RESIDENTIAL PLANNED UNIT DEVELOPMENT CONCEPT PLAN, VARIANCE, PRELIMINARY
PLAN/PLAT, AND CONDITIONAL USE PERMIT FOR JOHN KAROS FOR HERITAGE WEST (84022) (RPUD
84-4)
WHEREAS, John Karos has requested approval of a Residential Planned Unit Development,
Concept Plan, Variance, Preliminary Plan/Plat, Conditional Use Permit and Rezoning
for Heritage West, a plat for 92 dwelling units on an approximate 30 acre site,
located east of Xenium Lane and east of 36th Avenue North extended; and
WHEREAS, the Planning Commission has reviewed the requests at a duly called Public
Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does approve the Residential Planned Unit
Development Preliminary Plan/Plat, and Conditional Use Permit for John Karos for
Heritage West, a plat for 92 dwelling units on an approximate 30 acre site located
east of Xenium Lane and west of 38th Avenue and 37th Avenue North, subject to the
following conditions:
1. Compliance with the City Engineer's Memorandum.
2. Removal of all dead or dying trees from the property at the owner's expense.
3. Payment of park dedication fees -in -lieu of dedication in accordance with the
Dedication Policy in effect at the time of filing the Final Plat.
4. Street names shall comply with the City Street Naming System.
5. Compliance with Policy Resolution No. 79-80 regarding minimim floor elevations
for new structures in subdivisions adjacent to or containing any open storm
water drainage facility.
6. Rezoning shall be finalized with filing of the Final Plat.
. 7. No Building Permits shall be issued until the Final Plat is filed and recorded
with Hennepin County.
8. Appropriate legal documents regarding Homeowner Association covenants and
restrictions as approved by the City Attorney, shall be filed with the Final
Plat.

9. Outlot A shall be platted as part of Xenium Lane right-of-way.
10. Prior to issuance of building permits for units wi'hin Block 6, the existing
structures shall be removed at the developer's expense.
11. No Building Permits shall be issued until a contract has been awarded for
municipal sewer and water.
12. Yard setbacks are 35 ft. front yard; 10 ft. side yard; and 25 ft. rear yard for
the single family detached units. Setbacks for the single family attached units
shall be finalized with the Ordinance required site plan review.
13. Staging of the development shall be in accordance with utility availability as
approved by the City Engineer.
14. Maximum density shall be 3.2 units per acre for the land at, or above the
established High Water Elevation per the adopted City Storm Water Drainage Plan
as verified by the City Engineer. The final number of units shall be 92 single
family dwellings. The assignment of bonus points shall be based upon the mix of
housing and the private open area; and, natural vegetation amenities to be
preserved as much as possible during construction.
15. A waiver from the 40 acre miminum size requirements for PUD's is contingent upon
an executed Development Contract and is approved on the basis that the proposal
Is an extension of a development that was approved under the PUD provisions.
16. No private drive access shall be permitted to Xenium Lane; all private drives
shall be provided by internal public streets.
17. The final grading plan shall provide berming along Xenium Lane to provide a
transition from the attached dwelling units to the roadway.
18. Construction vehicle traffic associates with the public utility and street
improvements shall enter from Xenium Lane.
The motion for adoption of the foregoing Resolution was duly seconded by
Councilmernber Crain , and upon vote being taken thereon, the
91 -lowing voted in favor thereof: Mayor Davenport, Councilmembers Neils,
Schneider and Crain
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
