Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota was held on the 2nd day of
July , 1984. The following members were present: Acting Mayor
SchnAider Councilmembers Moen and Crain
The following members were absent: Mayor Davenport and Counci mem er ei Is .
Councilmember Craii, introduce the following Resolution and moved
its adoption:
RESOLUTION NO. 84- 436
AMENDING RESOLUTION NO. 84-264, APPROVING THE FINAL PLAT AND
DEVELOPMENT CONTRACT FOR ZACHARY HILLS 3RD AND 4TH ADDITION
FOR MARVIN H. ANDERSON CONSTRUCTION COMPANY (79045)
WHEREAS, Marvin H. Anderson Construction Company has requested an amendment to
the final plat and development contract for Zachary Hills 4th Addition,
approved by Council Resolution 84-264; and
WHEREAS, Marvin H. Anderson Construction Company will plat all 52 lots but will
provide utility and street service to 26 lots; and
WHEREAS, the City staff has prepared an amended development contract wit
language reflecting said changes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA that it should and hereby does approve the request of
Marvin H. Anderson Construction Comptny for an amendment to the development
10 contract reducing the number of lots to be serviced by utilities and streets
from 52 to 26 (Lots 1, 2, 18, 19, 20, 21, Block 1; Lots 1 - 4, Block 2; Lots
1 - 5, Block 3; Lots 1 and 2, Block 4; Lots 1 - 9, Block 5), thereby amending
said resolution.
FURTHER, that the amended development contract for said plat be approved and
that the Mayor and the City Manager be authorized to execute the development
contract on behalf of the City.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Moen , and upon vote being taken thereon, the
following voted in favor thereof: Acting Mayor Schneider, Councilmembers
Moen and Crain
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
