The following members were presents Acting Mayor Sc Heider, Counci mem ers The following members were absents Mayor Davenport, Councilmember Neils CoUncilmember Crain introduced the following Resolution and moved its ons RESOLUTION NO. 84-426 APPROVING A CONDITIONAL USE PERMIT AMENDMENT FOR ROSE CONFECTIONS, INC. (84036) WHEREAS, Rose Confections, Inc. has requested a Conditional Use Permit Amendment to operate a retail outlet store for sale of excess merchandise at their facility in the Industrial District at 700 Berkshire Lane; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the request by Rose Confections Inc. for a Conditional Use Permit Amendment to operate a retail outlet store for sale of excess merchandise at their facility in the Industrial District at 700 Berkshire Lane, subject to the following: 1. The permit is subject to all applicable codes, regulations and Ordinances, and violation thereof shall be grounds for revocation. 2. The permit is issued to the petitioner as operator of the facility and shall not be transferable. 3. The site shall be maintained in a sanitary manner. 4. There shall be no outside display sales or storage of merchandise or related materials. 5. Hours of operation shall be limited to 9:00 A.M. to 5:30 P.M. Monday through Friday; and, 9:00 A.M. to 2:00 P.M., Saturdays. 6. The permit shall be renewed in one year to assure compliance with the conditions. 7. All parking related to the use shall be on-site. 8. No additional permanent signs shall be installed, and any signage on the site re- lated to this use shall be subject to the requirements of the Ordinance. 9. Curbing be installed around the parking areas prior to issuance of the permit. A financial guarantee shall be submitted for the completion of the improvements. FURTHER, Resolution No. 81-145 is hereby rescinded.
