Councilmember Crain introduced the following Resolution and moved its adoption: RESOLUTION NO. 84- 416 AUTHORIZING THE VACATION OF UTILITY AND DRAINAGE EASEMENT - OUTLOT C, PLYMOUTH CREEK 2ND ADDITION WHEREAS, the petition to vacate a certain utility and drainage easement in Outlot C of Plymouth Creek 2nd Addition was received by the City Council; and WHEREAS, a public heariro with respect to said vacation was held on July 2, 1984 in accordance wi&n Minnesota Statutes 412.851, as amended; and WHEREAS, a notice of publication of said hearing was held and posted two weeks prior to the meeting of July 2, 1984; and WHEREAS, the Council did hold a public hearing on July 2, 1984 to inform any and all interested parties relative to the vacation of said easement in Outlot C, Plymouth Creek 2nd Addition; and WHEREAS, it was determined by the City Council that said drainage and utility easement in Outlot C, Plymouth Creek 2nd Addition is not for a public easement: NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA as follows: 1. That the Qxisting drainage and utility easement shown within Outlot C of Plymouth Creek 2nd Addition (generally being 20 feet in width) is hereby vacated. 2. That said vacation shall not be filed until_ such time that the final plat for Plymouth Creek 4th Addition is filed and recorded with Hennepin County. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Moen , and upon vote being taken thereon, the following voted in favor thereof: Acting Mayor Schneider, Councilmembers Moen and Crain The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted. ,kink ak�4tk iIr9M�k
