HomeMy WebLinkAboutCity Council Resolution 1984-414CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 2nd day of July , 1984. The following members were present: Acting Mayor Schneider Councilmembers Moen and Crain The following members were absent: Mayor Davenport and Counci member Nei s. Councilmember Crain introduced the following Resolution and moved its adoption: RESOLUTION NO. 84- 414 ATHORIZING THE VACATION OF STREET RIGHT-OF-WAY LYING SOUTHERLY OF "PARK" PARCEL ON 13th AVENUE IN SUBURBANDALE ON PARKER LAKE WHEREAS, the City desires to vacate the street right-of-way of a portion of 13th Avenue as platted within Suburbandale on Parker Lake; and WHEREAS, the public hearing with respect to said vacation was held on July 2, 1984 in accordance with Minnesota State Statutes 412.851, as amended; and WHEREAS, the notice of public of said hearing was published and posted two weeks prior to the meeting of July 1, 1984; and WHEREAS, the Council did hold the public hearing on July 2, 1984 to inform any and all interested parties relative to the vacation of said 13th Avenue; and • WHEREAS, it was determined by the City Council that 13th Avenue is not needed for a public street;; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA as follows: 1. That the following portion of 13th Avenue in Suburbandale on Parker Lake is vacated as follows: Vacate all public roadway lying between the following two lines: Line 1: Beginning at the Northeast corner of Lot 15, Block 5, thence easterly to the Northwest corner of Lot 3, Block 5, both in Suburbandale on Parker Lake, and there terminating. Line 2: Beginning at the Southeast corner of Lot 15, Block 5, thence easterly to the Southwest corner of Lot 3, Block 5, both in Suburbandale on Parker Lake, and there terminating Resolution No. 84- 414 Page Two 2. That said -nation shall not affect the authority of any person, corpo- ration or municipality owning or controlling the electric or telephone poles and lines, gas and sewer lines, or water lines, mains and hydrants thereon or thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to repair, replace, remove or otherwise attend thereto.
