The following members were present: Mavnr Quin= , m ers oen Neils, Schneider and Crain e o owing mem ers were absent: CO ncil er Schneider introduced the following Resolution and moved its adoption: RESOLUTION NO. 84-395 AUTHORIZING THE VACATION OF A PORTION OF 16TH AVENUE NORTH ADJACENT TO LOT 1, BLOCK A, PLYMOUTH ORCHARDS AND BLOCK 7, BEACON HEIGHTS IST ADDITION WHEREAS, a petition was received to vacate a portion of 16th Avenue North adjacent to Lot 1, Block A, Plymouth Orchards and Block 7, Beacon Heights 1st Addition; and WHEREAS, a public hearing with respect to said vacation was scheduled on May 21, 1984 in accordance with Minnesota Statute 412.851, as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of May 21, 1984; and WHEREAS, the Council did hold a public hearing on May 21, 1984 to inform any and all interested parties relevant to the vacation of a portion of 16th Avenue North adjacent to Lot 1, Block A, Plymouth Orchards and Block 7, Beacon Heights 1st Addition; and WHEREAS, it was determined by the City Council that action should be deferred on the requested vacation until such time as clarification is received from the District Right -of -Way Engineer for the Minnesota Department of Transportation; and WHEREAS, on June 5, 1984 the Minnesota Department of Transportation notified the City of Plymouth that the portion of 16th Avenue North proposed to be vacated is not part of the trunk highway right-of-way; and WHEREAS, on April 3, 1962 the Village of Plymouth accepted the portion of County Road No. 6 (16th Avenue North) abandoned because of the relocation of County Road No. 6 and Hennepin County relinquished any future claims to this right-of-way; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH as follows: 1. That the following portion of 16th Avenue North adjacent to Lot 1, Block A, Plymouth Orchards and Block 7, Beacon Heights First Addition be vacated as public roadway. That part of the South 1/2 of the Southwest 1/4 of Section 26, Township 118, Range 22, Hennepin County, Minnesota, lying southwesterly of the southwesterly right-of-way line of State Trunk Highway 55 and southerly of ' the South line of the Northwest 1/4 of the Southwest 1/4, of said Section 26, and northerly of the southerly line of said Old County Road No. 6 and lying southeasterly of the circumference of a circle having a radius of 70.00 feet. The center of said circle described as being a point Resolution No. 84- 395 Page Two 1. (continued) 20.00 feet Northerly of the North line of said South 1/2 of the Southwest 1/4 on a line that is 62.00 feet easterly of, measured at a right angle to, and parallel with, the northerly extension of the west line of said South 1/2 of the Southwest 1/4. That part of the northerly 17.00 feet of Block 7, Beacon Heights let Addition, according to the recorded plat thereof, Hennepin County, Minnesota, lying southwesterly of the southwesterly line of State Highway No. 55 except that part of said northerly 17.00 feet embraced within the circumference of a circle having a radius of 70.00 feet. The center of said circle described as being a point 20.00 feet northerly of the north line of the South 1/2 of the Southwest 1/4 of Section 26, Township 118, Range 22, Hennepin County, Minnesota, on a line that is 62.00 feet easterly of'the northerly extension of the west line of said South 1/2 of the Southwest 1/4. The south 17.00 feet of the north 50.00 feet of that part of 16th Avenue North lying within Lot 1, Block A, Plymouth Orchards, according to the recorded plat thereof, Hennepin County, Minnesota, lying easterly of the went line of said Lot 1 and Westerly of the east line of said Lot 1. 2. That said vacation shall not affect the authority of any person, corpo- ration, or municipality owning or controlling electric or telephone poles . and lines, gas and sewer lines, or water pipes, mains and hydrants thereon or thereunder, to continue maintaining the same to enter upon such way or portion thereof vacated to repair, replace, remove or otherwise attend thereto. 3. That the City of Plymouth reserves easement rights for utility purposes over, under and across said vacated street. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Neils , and upon vote being taken thereon, the following voted in favor thereof: Mayor Davenport, Councilmembers Moen, Neils, The tollowing voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted. iHtdt '#44 �k�katr
