June . 19 84. The following members were present: Mayor Davenport, Councilmembers Moen, Nif s, Schneider and Crain followingThe s were sent; -, nogg „ Councilmember Crain introduced the following Resolution and moved its adoption: RESOLUTIUN NO. 84- 390 DENYING THE APPEAL BY DENNIS S. ANDERSON OF BOARD OF ZONING ADJUSTMENTS AND APPEALS RULING WHEREAS, Dennis S. Anderson, pursuant to Section 11, Subdivision C of the Plymc-Ith Zoning Ordinance, has appealed the May 14, 1984 ruling of the Board of Adjustments and appeals relative to his request for a variance at 12620 - 28th Avciue North, also described as Lot 3, Block 1, CREEKWOOD HEIGHTS 2ND ADDITION; and, WHEREAS, the petitioner requested a variance of 4 feet from the Ordinance minimum requirement for 10 feet from the side property line to a principal structure in order to construct an addition onto his existing attached garage; and, WHEREAS the Board of Zoning considered the matter on May 14, 1984, at which time the ruling was made to deny the variance request as submitted, ar;d to approve a variance for 2 feet; and, WHEREAS, the City Council has reviewed the proceedings of the Board of Zoning Adjustments and Appeals, as well as the petitioner's application for the variance and for the appeal; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does deny the appeal of Dennis S. Anderson, of the Board of Zoning Adjustments and Appeals ruling, granting a 2 ft. variance from the ordinance minimum side yard setback standard.
