The following members were present: Mayor Davenport. Councilmembers Moen, Nei s, Schneider and Crain fellom�lng amberswere a sent: none Com cilmember Schneider introduced the following Resolution and moved its adoption: RESOLUTION NO. 84- 389 APPROVING SITE AMENDMENT AND SETTING CONDITIONS RELATING TO THE LOT CONSOLIDATION FOR JEROME LAVIN, CORDON do FERGUSON COMPANY (84046) WHEREAS, Jerome Lavin, Gordon do Ferguson Company has requested approval of a Site Plan to allow the expansion of the existing 459696 sq. ft. building by 29,872 sq. ft. for a total building size of 75,568 sq. ft. located southwest of Highway 55 and Niagara Lane; and, WHEREAS, the Planning Commission has reviewed said request and recommends approval; and, WHEREAS, the City Council has approved a Lot Consolidation as requested by the applicant; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for Jerome Lavin, Gordon do Ferguson Company for approval of a Site Plan Amendment to expand an existing building located southwest of Highway 55 and Niagara Lane subject to the following conditions which also apply to the approved Lot Consolidation of the property: 1. Compliance with the City Engineer's Memorandum. 2. Compliance with Policy Resolution Me. 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. 3. Submission of required Site Performance Agreement and financial guarantee for completion of site improvements. 4. Any signage shall be in compliance with the Ordinance S. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 6. All waste and waste containers shall be stored within the structure and no outside storage is permitted. 7. No Building Permit to be issued until the Lot Consolidation is filed with Hennepin County. PLEASE SEE PAGE TWO Page two Resolution No. 84- 389 8. Submittal of all necessary utility easements prior to filing Lot Consolidation with Hennepin County. 9. Approval of deferred construction of 35 parking spaces until such time the City deems the additional spaces are necessary. At that time, the spaces shall be constructed in accordance with the Ordinance provisions and "proof -of -parking" plan dated May 18, 1984.
