The following mII1 3 were present:Mayor Davit. Councilmembars Moen. Neils_ SQhqgjdqc and Grain Me followIng members were : none Councilmember Neils introduced the following Resolution and moved its adoption: RESOLUTION NO. 84- 346 SETTING CONDITIONS PRIOR TO FILING AND REGARDING MPUD FINAL PLAN/PLAT FOR LYMAN LUMBER COMPANY AND GONYEA INVESTMENT COMPANY FOR GLEN ECHO PONDS (MPUD 84-1) (84008) WHEREAS, the City Council has approved the MPUD Final Plan/Plat and Development Con- tract for Glen Echo Ponds as requested by Lyman Lumber Company and Gonyed Investment Company. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does direct the following prior to filing and regarding said plat: 1. Compliance with the City Engineer's Memorandum. 2. The Ordinance rezoning the property shall be published upon evidence that the Final Plat has been filed and recorded with Hennepin County. 3. Provisions for a 15 -ft. side trail easement along the south and east side of the industrial parcel (Lot 22, Block 1), and a 15 -ft. outlot (Outlot D) along the west boundary of the residential area per Comprehensive Park Plan, as verified by the Parks do Engineering Department, with submittal of detailed plans as to construc- tion of the trail per City standards; and, that the trail construction shall be Included in the first phase of development. 4. Appropriate credit for acreage and costs of paving shall be applied toward the dedication requirements for the residential portion; any remaining dedication re- quirements shall be cash fees -in -lieu of land dedication in accordance with the Dedication Policy in effect at the time of filing the Final Plat. 5. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedi- cation Policy in effect at the time of Building Permit issuance for Lot 22, Block 1. 6. No Building Permits shall be issued until the Final Plat is filed and recorded at Hennepin County. 7. Submittal of required utility and drainage easements as approved by the City ' Engineer prior to filing the Final Plat. PLEASE SEE PAGE TWO Page two Resolution No. 84- 346 8. The Final Plat mylars shall contain a statement referring that the plat is part of approved MPUD 84-1 per Section 9 of the Zoning Ordinance. 9. Permits may be issued for a model home, provided that no occupancy shall be permitted until the Final Plat has been recorded and until municipal utilities have been installed. Item 14.14 of the Development Contract, and Items 22 A and 22 3 of the May 21, 1984 Engineer's Memorandum shall be revised to reflect this approval for a model home. The emotion for adoption of the foregoing Resolution was duly seconded by Councilmember Schneider, and upon vote being taken thereon, the following voted in favor thereof: Mayor Davenoorl,, Councilmembers Moen, Neils.
