Pursuant to due call and notice thereof, aregular meeting of the City Council of
the City of Plymouth, Minnesota, was held on the 21st day of Ma 1984.

Co ncilmember Moen introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 84- 313
APPROVING REVISED RESIDENTIAL PLANNED UNIT DEVELOPMENT CONCEPT PLAN, PRELIMINARY
PLAN/PLAT, CONDITIONAL USE PERMIT FOR CENTEX HONES MIDWEST FOR WINCHESTER (RPUD 84- )

WHEREAS, THE City Council approved plans for a Residential Planned Unit Development
"Zachary Court", for Marvin Anderson Construction Company for approximately 32.6
acres at the southwest corner of Zachary Lane and Hamel Road on June 1, 1981 under
Resolution No. 81-343; and,
WHEREAS, Centex Homes Midwest has requested approval of a Revised Residential Planned
Unit Development Concept Plan, Preliminary Plan/Plat, Conditional Use Permit, for
Winchester, a plat for 100 single family detached dwelling units on that site; and,
WHEREAS, the Planning Commission has reviewed the request at a duly called Public
Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does approve the Revised Residential Planned
Unit Development Concept Plan, Preliminary Plan/Plat and Conditional Use Permit and
for Centex Homes Midwest for Winchester a plat for 100 single family detached dwel-
lings to be located in the southwest corner of Zachary Lane and Hamel Road, subject
to the following conditions:
1. Compliance with the City Engineer's Memorandum.
2. Removal of all dead or dying trees from the property at the owner's
expense.
3. No Building Permits shall be issued until a contract has been awarded for
sewer and water.
4. Provisions for a 30 -ft. wide trail easement per Comprehensive Park Plan, as
verified by the Parks and Engineering Departments, with submittal of de-
tailed plans as to construction of the trail per City standards.
5. Payment of park dedication fees -in -lieu of dedication with appropriate
credits in an amount determined according to verified paving costs and ac-
cording to the Dedication Policy in effect at the time of filing the Final
Plat and in accordance with the agreement approved under Resolution No. 83-
292, as amended.

6. Street names shall comply with the City Street Naming System.
7. No Building Permits shall be issued until the Final Plat is filed and
recorded with Hennepin County.
8. Yard setbacks are as shown on the RPUD Plan.
9. Appropriate legal documents regarding Homeowner Association covenants and
restrictions as approved by the City Attorney, shall be filed with the
Final Plat.
10. No private drive access shall be allowed to Zachary Lane or Hamel Road.
11. Prior to City Council consideration of the Final Plat, the petitioner shall
submit for Planning Commission review and action; a detailed typical
landscape plan for the development, substantially consistent with the 1980
approved Landscape Plan; and, a revised sign plan where the proposed two
signs will be reduced in area to less than 25 sq. ft.
12. Permit temporary access across Arrowhead Lane on Hamel Road to the model
area, to be closed at 90% completion or 3 years, whichever occurs first.
13. All private drives shall be a minimum of 25 ft. in length, and a minimum
double car width. Each lot shall accommodate double car garage without
variances.
The notion for adoption of the foregoing Resolution was duly seconded by
Councilmember Neils 9 and upon Mote being taken thereon, the
