HomeMy WebLinkAboutCity Council Resolution 1984-286CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 7th day of May , 1984. The following members were present: AcFing mayor . Schneider, Councilmembers Moen, Neils and Crain The following members were absent: Mayor Davenport Councilmember Neils introduced the following Resolution and moved its adoption RESOLUTION NO. 84- 286 AUTHORIZING THE VACATION OF LARCH LANE NORTH OF COUNTY ROAD 9 WHEREAS, a petition was received to vacate all that part of Larch Lane north of County Road No. 9 and 1308.41 feet south of the north line of Section 14, Township 118, Range 22; and also the east one half of Larch Lane from the north line of Section 14, Township 118, Range 22 to a point 1308.41 feet south; and WHEREAS, a public hearing with respect to said vacation was scheduled on April 16, 1979 in accordance with Minnesota Statutes 412.851, as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of April 16, 1979; and WHEREAS, the Council did hold a public hearing on April 16, 1979 to inform any and all interested parties relevant to the vacation of Larch Lane north of County Road 9; and WHEREAS, it was determined by the City Council that with the relocation of Larch Lane, a certain portion of Larch Lane is not needed for a public street; and WHEREAS, the City Council did adopt Resolution No. 79-234 whereby a certain portion of Larch Lane was vacated but Hennepin County requested that the legal description be clarified; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH as follows: 1. That the following portion of Larch Lane be vacates; as public roadway. All that part of Larch Lane North of County Road No. 9 and 1308.41 feet South of the North line of Section 14, Township 118, Range 22, lying in the East 33 feet of the Southwest 1/4 of the Northwest 1/4 and the West 33 feet of the Southeast 1/4 of the Northwest 1/4 of said Section 14, including that portion of Larch Lane curving Southeasterly and intersecting County Road No. 9 approximately 250 feet East of the Southwest corner of the Southeast 1/4 of the Northwest 1/4 of said Section 14; and also the East one half of Larch Lane from the North line of Section 14, Township 118, Range 22 to a point 1308.41 feet South, lying in the West 33 feet of the Northeast 1/4 of the Northwest 1/4 of said Section 14. That said vacation shall not affect the authority of any person, corporation, or municipality owning or controlling electric or telephone poles and lines, gas and sewer lines, or water pipes, mains and hydrants thereon or thereunder, to continue maintaining the same to enter upon such way or portion thereof vacated to repair, replace, remove or otherwise attend thereto. 3. That said vacation shall not affect those portions of Old Larch Lane platted as street right-of-way in the following plats: a. West Ridge Estates First Addition b. West Ridge Estates Second Addition c. West Ridge Estates Fifth Addition 4. That said vacation shall not affect those portions of Old Larch Lane immediately adjacent to Outlot D in West Ridge Estates First Addition and 42nd Avenue in West Ridge Estates Fifth Addition. The motion for the adoption of the foregoing Resolution was duly seconded by and upon vote being taken thereon, the following voted In favor t ereof:Acting Mayor Schneider, Councilmembers Moen, lei1s and Crain The fol owing voted aga nst or abstained: none Whereupon the Resolution was declared duly passed and adopted.
