HomeMy WebLinkAboutCity Council Resolution 1984-275CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held onthe 7th day of May . 1984. The following members were present: Acting Mayor Schneider, Councilmembers Moen, Neils andCrain The following â– embers were absent: Mayor Dayenoort Councilmember Moen introduced the following Resolution and moved its adoption: RESOLUTION NO. 84- 275 DENYING VARIANCE FROM THE SUBDIVISION CODE FOR LOT DIVISION FOR RICHARD PALMQUIST FOR PROPERTY LOCATED SOUTHWEST OF COUNTY ROAD 15 AND PINEVIEW LANE (84009) WHEREAS, Richard Palmquist has requested approval of a Variance from the Subdivision Code to divide an existing unplatted parcel located southwest of County Road 15 and Pineview Lane; and, WHEREAS, the Planning Commission has reviewed said request and recommends denial; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does deny the request of Richard Palmquist for a Variance from the Subdivision Code for Lot Division for the following reasons: 1. The applicant has not demonstrated that there are special circumstances or conditions affecting the specific property, such that the strict application of the provisions of this Section would deprive the applicant of the reasonable use of the land. 2. The applicant has not demonstrated that a variance is necessary for the preservation and enjoyment of a substantial property right of the applicant. 3. It has not been demonstrated that, without a variance, an unusual hardship would exist on the land. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Neils and upon vote being taken thereon, the ToTfoming voted In favor t f:Acting Mayor Schneider, CouncilmembIrs Moen, Neils and Crain The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
