HomeMy WebLinkAboutCity Council Resolution 1984-261Aft CITY OF PLYMOUTH Pursuant to due call and notice thereof, a ,regular meeting 04 the City Council of the City of Plymouth, Minnesota, was held on the 7th day ofMa 19 84 The following members were present: Acting Mayor Sc Heider, Counci members—Moen, Neils and Crain The following members were absent: Mayor Davenport Councilmember Neils introduced the following Resolution and moved it- adoption: RESOLUTION No. 84- 261 RESOLUTION AMENDING AGREEMENT REGARDING SEGMENTED REVIEW OF PARKERS LAKE MPUD AS APPROVED UNDER RESOLUTION NO. 83-292 (82066) WHEREAS, the City Council adopted Resolution No. 83-292 on June 6, 1983, amending Resolution No. 83-134, and approving an Agreement with the City of Minneapolis and with Lundgren Brothers Construction Company relative to segmenting the review and approval process for the Parkers Lake Planned Development MPUD: and, WHEREAS, Lundgren Brothers Construction Company and the City of Minneapolis have requested certain amendments to that Agreement reflecting the current status of the project, and reflecting current marketing and development concerns in Stage A; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Amendment of the Agreement with the City of Minneapolis and Lundgren Brothers Construction Company as originally adopted under Resolution No. 83-292, and as contained in Exhibit A dated May 7, 1984; BE IT FURTHER RESOLVED, that upon adoption, both the City of Minneapolis and Lundgren Brothers Construction Company shall provide written acknowledgement of the terms and requirements of said Agreement. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Crain Iand upon vote being taken thereon, t s following voted n favor thereof: Acamino Mayor Schneider. _CounciIMembers Moen_ Neils The f-ellowift r" :against or abstained: noog Whereupon the Resolution was declared duly passed and adopted. lb DATED: May 7, 1984 EXHIBIT A PARKERS LAKE PLANNED DEVELOPMENT -AGREEMENT f 1. The proposed Parkers Lake Planned Development MPUD will be split into two stages: a) Stage A: "The Vicksburg West Property," is that portion west of Vicksburg Lane; and, b) Stage B: "The Parkers Lake North Prop;:.-ty," is that portion east of Vicksburg Lane. STAGE A: The Vicksburg West Property - Parked. Lake MPUD 2. The preliminary plat/plan, conditional use permit, and rezoning application will be submitted for Stage A. It will be reviewed on its own merits and measured against the approved Concept Plan and the City Ordinance Planned Unit Development standards. 3. The required Environmental Assessment Worksheet (EAW) for Stage A will also be submitted with the application, and review of the EAW will commence with the re- view of the petition. The intent is that the EAW will be processed per the re- quired Environmental Quality Board (EQB) regulation review process, so that the eventual finding by the City Council, as to whether an Environmental Impact State- ment (EIS) is required, could be made concurrently with ac%lon on the preliminary plat. 4. The PUD application for Stage A will involve only this stage, and density would be calculated for only this stage. 5. Park dedication requirements will be calculated for Stage A based upon the ap- proved density according to the Park Dedication Policy. 6. Upon approval of the preliminary plat/PUD Plan, conditional use permit, and rezon- ing for Stage A, the developer will submit the final plat for Stage A; consisting of two phases: Phase I will be the approximate 20 acres platted as Lots and Blocks, including one or more outlots for public purposes; Phase II will be the balance of Stage A and be platted as one or more outlots. 7. Planning applications for further preliminary platting of, or revisions to the ap- proved plans for Stage A, Phase II outlots, may be submitted to the City for processing and approval. 8. The City Councll will consider the replatting of Stage A. Phase II outlots and final platting of up to 40 single family lots within Phase II of Stage A. follow- ing approval of the preliminary plat/plan for Stage B. or not later than June 4, 1984, if the Council finds that approval of the preliminary plat for Stage B has `teen delayed for causes beyond the reasonable control of the Petitioner or its Ayent. No further final platting of Stage A will be allowed until the final plat for Stage B has been approved and filed at the County. An application for preliminary plat/PUD Plan, conditional use permit, and rezoning for Stage B will be submitted, as will the Environmental Impact Statement (EIS) which is required for Stage B. not later than 60 days from the date the Stage A final plat is filed at Hennepin County. The PUD Plan submitted will include the approved PUD Plan for Stage A. STAGE B: The Parkers Lake North Property - Parkers Lake MPUD 10. The Stage B application will be reviewed on its merits and measured against the approved Concept Plan and the Ordinance PUD requirements. The determination of density for Stage B will include an evaluation of the approved Stage A PUD Plan for purposes of calculating any applicable density bonus points. Any density bon- us points assignable to the entire PUD Plan will be applied to the Stage B PUD Plan. 11. Any park dedication requirements for Stage A, not satisfied by land dedication in Stage A, will be carried over to Stage B; and, all final park dedication require- ments or credits, including timing of transfer to the City, will be determined or applied with the final plat for Stage B. 12. The required Environmental Impact Statement (EIS) will be processed according to Environmental Quality Board (EQB) regulations and action on the preliminary plat by the Council will precede or coincide with initial action regarding the scoping document. 13. The petitioner will submit the initial final plat for Stage B which may consist of one or more phases and which may be platted as one or more outlots. 14. The initial Final Plat for Stage B will a filed at Hennepin County prior to sub- mittal of any plat for Stage A, Phase II outlots beyond the platting and/or plan revision allowed under item numbers 7 and 8 above. ENVIRONMENTAL REVIEW► 15. The City of Minneapolis will enter into an agreement with the City of Plymouth (Responsible Governmental Unit) for carrying out the necessary work for processing an environmental impact statement (EIS). This agreement will be in accordance with Environmental Quality Board (EQB) regulations. The petitioner and RCU staff will work jointly in developing an RFP for any necessary consulting work relative to the EIS. letterbt
