NOi' Schneider and Crain The following aPers were absent: none Coupcilmember Neils introduced the following Resolution and moved its adopt on: RESOLUTION NO. 84-250 APPROVING RESIDENTIAL PLANNED UNIT DEVELOPMENT PRFLININARY PLAN/PLAT, AND CONDITIONAL USE PERMIT FOR ROGER FAZENDIN, FOR -THE VILLAGES BY FAZENDIN (83061) (RPUD 84-2) AREAS, Roger Fazendin has requested approval of a Residential Planned Unit Development Preliminary Plan/Plat and Conditional Use Permit for The Villages by Fazenain for 16 new single family residential units, and retention of two existing single family homes for a total of 18 dwelling units on approximately 12.5 acres located at 18700 11th Avenue North; and, WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Residential Planned Unit Dev- elo peent Preliminary Plan/Plat, and Conditional Use Permit for Roger Fazendin for The Villages by Fazendin for 18 single family dwelling units on approximately 12.5 acres located at 18700 11th Avenue North, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all dead or dying trees from the property at the owner's ex pense. 3. No Building Permits shall be issued until a contract has been awarded for municipal sewer and water. 4. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of filing the Final Plat. 5. Street names shall comply with the City Street Naming System. 6. Compliance with Policy Resolution No. 79-80 regarding minimum floor eleva- tions for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 7. No Building Permits shall be issued until the Final Plat is filed and recorded with Hennepin County. PLEASE SEE PAGE TWO Page two Resolution No 84- 250 8. Appropriate legal documents regarding Homeowner Association documents, covenants anti restrletions as approved by the City Attorney, shall_ be filed with the Final Plat. 9. The cul-de-sac for 11th Avenue North shall be reduced in length apprxoimately 30 to 35 ft. and a modified landscape plan shall be prepared with additional trees to be installed at the north end of the cul-de-sac.
