Pursuant to due call and notice thereof, a regular meeting of the City Council of

RESOLUTION NO. 84- 223
APPROVING PRELIMINARY PLAT AND VARIANCES FOR 3" DEVRIES, DEVRIES BUILDERS, INC. FOR
DEVRIES 3RD ADDITION (84014)
WHEREAS, John Devries, Devries Builders, Inc. has requested approval of a Preliminary
Plat and Variances for the division of approximately 16.6 acres into 5 lots for
single famiiy residential dwellings and one outlot located west of County Road 18 and
generally east of Pilgrim Lane; and,
WHEREAS, the Planning Commission has reviewed the request at a duly called Public
Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE' CITY OF PLYMOUTH,
' MINNESOTA, that it should and hereby does approve the Preliminary Plat and Variances
for John Devries, Devries Builders Inc. for the division of land located west of
County Road 18 and generally east of Pilgrim Lane into 5 lots for single family
residential dwellings and one outlot, subject to the following conditions:
1.
Compliance with the City Engineer's Memorandum.
2.
Removal of all dead or dying trees from the property at the owner's
expense.
3.
No Building Permits shall be issued until a contract has been awarded
for
sewer and water.
4.
Payment of park dedication fees -in -lieu of dedication are satisfied in
ac-
cordance with the City's agreement for purchase of Outlot A.
5.
Street Names shall comply with the City Street Naming System.
6.
Compliance with Policy Resolution No. 79-80 regarding minimum floor eleva-
tions for new structures in subdivisions adjacent to, or containing
any
open storm water drainage facility.
7.
No Building Permits shall be issued until the Final Plat is filed and
re-
corded with Hennepin County.

. 8. No yard setbacks are granted or implied.
9. Approved variances are for minimum lot widths of 90 ft., rather than 110
ft, based on the finding that the City Code Variance Criteria have been
met.
10. The existing barn on proposed Lot 4, Block 1, may be used in lieu of a
construction trailer until 85% of the subdivisions known as Devries 2nd and
3rd Additions are developed, or three years, which ever occurs first. No
Certificate of Occupancy shall be issued for Lot 4, Block 1 until the barn
Is removed. The required financial guarantee for subdivision improvements
shall cover the eventual removal of the barn.
11. At such time as the present home located on proposed Lot 5 is removed, the
City agrees the division of Lot 5, Block 1 into two residential lots may
occur.
The motion for adoption of the foregoing Resolution was duly seconded by
Councilmember Moen and upon vote being taken thereon, t e
