The following members were present: Mayor Davenpor ounciImembers Moen, n;Ne;js, Schneider and Crain The 0 e— s were none �ouncilmember Neils introduced the following Resolution and moved its adoptlon: RESOLUTION NO. 84- 222 SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT FOR PLYMOUTH ORCHARDS 2ND ADDITION (84013) WHEREAS, the City Council has approved a Final Plot for Plymouth Orchards 2nd Addition as requested by Northwestern Bell; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to be met, prior to recording of, and related to said plat: 1. Compliance with the City Engineer's Memorandum. 2. Payment of park dedication fees -in -lieu of dedication in accordance with City Policy in effect at the time of issuance of Building Permit for Lot 1, Block 10 1. 3. Removal of all dead or dying trees from the property at the owner's expense. 4. No yard setback variances are granted or implied for Lot 1, Block 1. 5. Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. 6. No Building Permits for Lot 1, Block 1 to be issued until the Final Plat is filed and recorded with Hennepin County. 7. Appropriate legal documents regarding shared access and utilities as approved by the City Attorney shall be filed with the Final Plat. 8. A financial guarantee and performance agreement shall be submitted to assure closure and removal of the drive to 16th Avenue North, per the Engineer's Memorandum, prior to filing the Final Plat.
