Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota was held on the 2nd day of
April , 1984. The following members were present: Mayor Davenport.
Councilmembers Moen, Neils, Schneider and Crain . The following members were
absent: none

Councilmember Neils introduced the following Resolution and moved its
adoption
RESOLUTION NO. 84- 170
AUTHORIZING THE VACATION OF A UTILITY AND DRAINAGE EASEMENT ON
LOT 1, BLOCK 2, MERRY MIDDLEMIST ADDITION
WHEREAS, a petition was received to vacate a utility and drainage easement on
Lot 1, Block 2, Merry Middlemist Addition; and
WHEREAS, a public hearing with respect to said vacation was held on April 2,
1984 in accordance with Minnesota statutes 412.851, as amended; and
WHEREAS, a notice of publication of said hearing was published and posted two
weeks prior to the meeting of April 2, 1984; and
WHEREAS, the Council did hold a public hearing on April 2, 1984 to inform any
and all interested parties relevant to the vacation of the utility and drainage
easement on Lot 1, Block 2, Merry Middlemist Addition; and
WHEREAS, it was determined by the City Council that said easement is not needed
for public purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH that the following drainage and utility easement be vacated:
A 20 foot wide drainage and utility easement over and across that part
of Lot 1, Block 2, MERRY MIDDLEMIST, Hennepin County, Minnesota, and
the centerline of said easement Is described as follows:
Commencing at the southwest corner of said Lot 1: thence northeast-
erly along the west line of said Lot 1 on an assumed bearing of North
22 degrees 51 minutes 24 seconds East a distance of 101.05 feet;
thence northeasterly 5.00 feet along a tangential curve concave to the
east, central angle 2 degrees 26 minutes 08 seconds, radius 117.62
feet, to the point of beginning of centerline to be described; thence
South 46 degrees East not tangent to last described curve a distance
of 125 feet more or less to the intersection with a lie, drawn from a
point of the east line of said Lot 1 distant 40 feet north of the
southeast corner thereof to a point on the south line of said Lot 1
distant 40.00 feet west of said southeast corner, and there termina-
ting.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Moen , and upon vote being taken thereon, tha
following voted in favor thereof: Mayor Davenport, Councilmembers Moen, Neils,
hneider and Crain

Whereupon the Resolution was declared duly passed and adopted.
