HomeMy WebLinkAboutCity Council Resolution 1984-081Extract of Minutes of Regular Meeting of the City Council of the City of Plymouth, Minnesota Pursuant to dus call and notice thereof, a regular meeting of the City Council (the "Council") of the City of Plymouth, Minnesota, was duly held at 7:30 o'clock p.m., at the City Hall, 3400 Plymouth Boulevard, on February 6, 1984. Upon roll call at said meeting, the following members of the Council were present: Mayor Davenport, Councilmembers Moen, Neils and Schneider and the following members were absent: Councilmember Crain Councilmember Neils introduced and read the resolution attached hereto, designated as follows, and moved its adoption: . RESOLUTION NO. 84-81 RESOLUTION CALLING FOR PUBLIC HEARING PURSUANT TO MINNESOTA STATUTES, SECTION 474.01, SUBDIVISION 7b, AND PUBLICATION OF NOTICE The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Moen , and upon vote being taken thereon, the following voted in favor thereof: Mayor Davenport, Councilmembers Moen, Neils and Schneider and the following voted against it: None whereupon said resolution was declared duly passed and adopted, and the Mayor and City Clerk were authorized to execute said resolution. RESOLUTION NO. 84-81 RESOLUTION CALLING FOR PUBLIC HtARING PURSUANT TO MINNESOTA STATUTES, SECTION 474.01, SUBDIVISION 7b, AND PUBLICATION OF NOTICE WHEREAS, a proposal has been made to the City Council (the "Council") of the City of Plymouth, Minnesota (the "City"), by Jerome V. Lavin and Sheila Ellen -Lavin d/b/a DAVICA Properties (the "Borrower"), to undertake a project (the "Project") pursuant to the Minnesota Municipal Industrial Development Act, Minnesota Statutes, Chapter 474 (the "Act"); and WHEREAS, the Project consists of acquisition of land and an existing building, renovation of the existing building and construction of an addition thereto, all for use as a manufacturing, shipping, warehousing and international headquarters facility to be leased to Gordon 5 Ferguson Companies and to be located at 2915 Niagara Lane and approximately five acres to the west and south thereof in the City; and WHEREAS, Section 474.01, Subdivision 7b, of the Act requires this Council to conduct a public hearing on said proposal and to publish notice of said public hearing not less than fifteen (15) days nor more than thirty (30) days prior to the date fixed for the hearing; and WHEREAS, the Borrower has delivered to this Council a draft copy of a proposed application to the Minnesota Energy and Economic Development Authority, together with all attachments and exhibits thereto, and said application, attachments and exhibits are now on file with the City Manager. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OP THE CITY THAT: 1. A public hearing shall be conducted by this Council on the proposal to undertake and finance the Project on March 5, 1984, at 7:30 o'clock p.m., at the City Hall, 3400 Plymouth Boulevard, in the City, at which hearing all parties who appear shall be given an opportunity to express their views with respect to said proposal. 2. Notice of the time and place of hearing, which shall contain (i) a general functional description of the type, use and nature of the Project, (ii) the estimated maximum aggregate face amount of the bonds or other obligations to be issued with respect to the Project, (iii) the initial owner, operator or manager of the Project, and (iv) the prospective location of the Project by its street address or# if none by a general description designed to inform readers of the specific location of the Project, shall be published at least once not less than fifteen (15) days nor more than thirty (30) days prior to the date fixed for the hearing in the official newspaper and in a newspaper of general circulation of the City. The notice shall state that a draft copy of the proposed application to the Minnesota Energy and Economic Development Authority together with all attachments and exhibits thereto, shall be available for public inspection following the publication of such notice and shall specify the place and times such application and its exhibits and attachments shall be so available.
