HomeMy WebLinkAboutCity Council Resolution 1984-071CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 6th day of February , 1984. The following members were present: Mayor Davenport, Councilrnembers Moen, Neils and Schneider The following members were absent: Coun71 mem er Crain Councilmember Schneider introduced the following Resolution and moved its adoption RESOLUTION NO. 84-71 AUTHORIZING THE VACATION OF STREET EASEMENT ZACHARY LANE ADJACENT TO S 1/2, N 1/2, SW 1/4, SEC. 12, T 118, R 22 WHEREAS, a petition was received to vacate that portion of Zachary Lane adjacent to Rolling Hills Park Addition; and WHEREAS, a public hearing with respect to said vacation was held on February 6, 1984 in accordance with Minnesota Statutes 412.851, as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of February 6, 1984; and WHEREAS, the Council did hold a public hearing on February 6, 1984 to inform any and all interested parties relevant to the vacation of Zachary Lane adjacent to Rolling Hills Park Addition; and • WHEREAS, it was determined by the City Council that a certain portion of Zachary Lane is not needed for public purposes; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH that the following road right-of-way be vacated: 1. That portion of Zachary Lane that lies within the South Half of the North Half of the Southwest Quarter of Section 12, Township 118, Range 22, Hennepin County, Minnesota. 2. That said vacation shall not affect the authority of any per- son, corporation or municipality owning or controlling electric or telephone poles and lines, gas and sewer lines, or water pipes, mains and hydrants thereon or thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to repair, replace, remove or otherwise attend thereto. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Neils , and upon vote being taken thereon, the • following voted in favor thereof: Mayor Davenport, Councilmembers Moen, Neils and Schneider Whereupon the Resolution was declared duly
