The followingmembers were presence a or Davenport, ounce mem ers els, Schneider and Crain The following members were absent: Counci mem er Moen +++t rrr Councilmember Schneider introduced the following Resolution and moved its adoption: RESOLUTION NO. 84- 06 ADOPTING ASSESSMENT SANITARY SEWER AREA AMD WATERMAIN AREA - PLYMOUTH PROJECT NO. 402 CREEK 3RD ADDITION WHEREAS, in conformance with the development contract we have received a waiver of assessment hearing from the property owner of Plymouth Creek 3rd Addition waiving their right to special assessment hearings covering the installation of water trunk facilities, sanitary sewer trunk facilities and all other appurtenances; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein and each tract of land herein included is hereby bound to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of 5 years, the first of the installments to be payable on or before the first Monday in January 1985 and shall bear interest at the rate of 10.33% per annum from the date of adoption of this assessment resolu- tion. To the first installment shall be added Interest on the entire assessment from the date of this resolution until December 31, 1985. To each subsequent Installment when due shall be added interest of one year on all unpaid Installments. The owner of any property so assessed may, at any time prior to certifica- tion of the assessment to the County Finance Director, pay the whole of the assessment on such property with Interest accrued to the date of payment to the City Treasurer, except that no interest shall be charged if the entire assessment is paid within thirty days from the adoption of this resolution; and he may, at any time thereafter, pay to the City Finance Director the entire amount of the assessment remaining unpaid with Interest accrued to December 31 of the year in which the payment is made. 4. The Clerk shall forthwith transmit a to the County Finance Director to be County and such assessments shall be manner as other municipal taxes. certified duplicate of this assessment extended on the proper tax lists of the collected and paid over in the same 5. The motion for the adoption of the foregoing Resolution was duly seconded by Mayor Davenport , and upon vote being taken thereon, the following voted in favor thereof: Mayor Davenport, Councilmembers Neils, Schneider and Crain Whereupon the Resolution was declared duly passed and adopted.
