HomeMy WebLinkAboutCity Council Resolution 1983-684CiTV t]F'PLyMfM)TH call and notice therecti'a19L weeting of the City Ca en a"- Ninneseta_ man hood t 29 .m., fte nnrak.d The fallCting wF�brs were Prosente Mayor UayenpolrT,-1U c1I en, Neils, Schneider and Threinen =- Covhcilmember Threinen intredured the following Resolution and waved adoptions RESOLUTION,NO. 83- 684 SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT FOR TIMBERTOM FOR THOMAS HEALEY, TIMBERTON COMPANY (83054) WHEREAS, the City Council has approved the Final Plat and Development Contract for Tim- berton as requested by Thomas Healey, Timberton Company; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that It should and hereby does approve the following to be met, prior to re- cording of, and related to said plat: 1. Compliance with the City Engineer's Memorandum. 2. Payment of park dedication fees -in -lieu of dedication in accordance with City Pol- ley in effect at the time of filing the Final Plat or at issuance of Buildlnc Per- mit. 3. Removal of all dead or dying trees from the property at the owner's expense. 4. Approved Variances include lot width and lot depth variances, as Identified In Ortober 13, 1983 correspondence from Sathre-Bergquist; and, building setback varl- ances as identified In project narrative dated October 18, 1983. 5. Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. 6. No Building Permits to be issued until the Final Plat is filed and recorded with Hennepin County. 7. Appropriate legal documents regarding Homeowner Association covenants and restric- tions as approved by the City Attorney, shall be filed with the Final Plat. 8. Any applicable conditions of approval from prior plat and plan approvals for Shen- andoah shall be brought forward and Incorporated with the Development Contract. 9. The petltSoner should submit prior to filing the Final Plat, written confirmation that h ere is an agreement with the Shendandoah Homeowner's Association as to type of recreational facility; to maintenance; and, to Its location per the April 24, 1978 letter setting forth the terms of the recreational facility escrow account.
