Thi foliowini embers were preseni.. mayor Davenport, MOM mem en, Neils, chne der n Threinen he following members were absent: •rw x*+ sra Councilmember Threinen introduced the following Resolution and moved its adoption RESOLUTION NO. 83- 678 AUTHORIZING THE VACATION OF STREET RIGHT-OF-WAY ANNAPOLIS LANE IN CRITERION M.P.U.D. WHEREAS, a petition was received to vacate a portion of Annapolis Lane as dedi- cated in the plat of Criterion M.P.O.D.; and WHEREAS, a public hearing with respect to said vacation was held on December 19, 1983 in accordance with Minnesota Statutes 412.851, as amended; and WHEREAS, a notice of publication of said hearino was published and posted two weeks prior to the meeting of December 19, 1983; and WHEREAS, the Council did hold a public hearing on December 19, 1983 to Inform any and all Interested parties relevant to the vacation of a portion of Annap- olis Lane as dedicated in the plat of Criterion M.P.U.D; and WHEREAS, it was determined by the City Council that said richt-of-way Is not needed for public purposes; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH that the following road riqht-of-way be vacated: 1. That part of Annapolis Lane as dedicated In the plat of Criterion M.P.U.O., according to the recorded plat thereof, described as follows: Beginning at a point on the North lira; of Lot 1, Block 1, Plymouth Business Center, according to the recorded plat thereof, a distance of 65.00 feet South 89 degrees 22 mtnutes 09 seconds West from the Northeast corner of said Lot it thence South 89 degrees 22 minutes 09 seconds West, a distance of 140.66 feet; thence Easterly and Northeasterly, along a tangen- tial curve, concave to the Northwest having a radius of 175.51 feet to the point of intersection with a line which bears South 0 degrees 06 minutes 35 seconds West and which runs through said point of beginning; thence South 0 degrees 06 minutes 35 seconds West to said point of beginning. Z. That said vacation shall not affect the authority of any person, cor- poration or municipality owning or controlling electric or telephone poles and lines, gas and sewer lines, or water;plpes, mains and hydrants thereon or thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated io'repair, replace, remove or otherwise attend thereto. 3. The City of Plymouth reserves an easem,;nt for trail and pedestrian purposes over that portion of said vacation parallel with and Immediately adjacent to the easterly 75 feet of the Criterion M.P.U.D. Addition.
