Councilmember Neils introduced the following Resolution and moved its

RESOLUTION NO. 83- 657
APPROVING RESIDENTIAL PLANNED UNIT DEVELOPMENT PRELIMINARY PLAN/PLAT AND CONDITIONAL
USE PERMIT FOR MISSION PARTNERSHIP FOR PARKVIEW APARTMENTS (RPUD 76-1) (A-338)
WHEREAS, Mission Partnership has requested approval of a Residential Planned Unit De-
velopment Preliminary Plan/Plat and Conditional Use Permit for Parkview Apartments, a
development consisting of 211 dwelling units In three buildings to be located at
County Road 9 and 41st Avenue North; and,
WHEREAS, the Planning Commission has reviewed the request at a duly called Public
Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does approve the Residential Planned Unit Bevel-
opment Preliminary Plan/Plat and Conditional Use Permit for Mission Partnership for
Parkview Apartments a development consisting of 211 dwelling units In three buildings
located at County Road 9 and 41st Avenue North, subject to the following conditions:
1. Compliance with the City Engineer's Memorandum.
2. Removal of all dead or dying trees from the property at the owner's
expense.
3. Payment of park dedication fees -in -lieu of dedication in accordance with
the Dedication Policy in effect at the time of issuance of Building Permit.
4. No Building Permits shall be Issued until the Final Plat is filed and
recorded with Hennepin County.
5. Approved yard setbacks are per the RPUD Site Plan.
6. Appropriate legal documents regarding Homeowner Association documents, cov-
enants and restrictions as approved by the City Attorney, shall he filed
with the Final Plat.
7. The final plat application shall include written verification from Hennepin
County Park Reserve District that a location for private trail access to
Medicine Lake Regional Park and maintenance terms for the trail and adjoin -
Ing fence have been determined. The trail shall he constructed to City
standards.

13. Building located on Lot 1 to be relocated to the south and additional
plantings shall be located on the south side of the building to further
shield the adjacent property as stated in a letter from Lundgren Brothers
Construction Company per Dennis Mulvey, dated November 29, 1983, and
additional plantings shall ve located along the west side of the building

The final plat application shall include a revised landscape plan
demonstrating compliance with the Landscape Policy; the plan shall speety
the location, species,
and size of any trees to be credited.

Total maximum number of units shall be 211, as designated on the approved
plan.

Submission of required Site Improvements Performance Agreement and
financial guarantee for completion of site Improvements.

Signage shall be in compliance with the Ordinance

All waste and waste containers shall be stored within the structures.
