Couneilmember Neils introduced the following Resolution and moved its
adoption
RESOLUTION NO. 83- 654
AUTHORIZING THE VACATION OF
STREET, SLOPE AND UTILITY EASEMENTS ADJACENT TO ZACHARY LANE
ADJACENT TO HARRISON HILLS ADDITION
WHEREAS, a petition was received to vacate street, slope and utility easements
adjacent to Zachary Lane adjacent to Harrison Hills Addition; and
WHEREAS, a public hearing with respect to said vacation was held on December 5,
1983 in accordance with Minnesota Statutes 412.851, as amended; and
WHEREAS, a notice of publication of said hearing was published and posted two
weeks prior to the meeting of December 5, 1983; and
WHEREAS, the Council did hold a public hearing on December 5, 1983 to inform any
and all interested parties relevant to the vacation of street, slope and utility
easements adjacent to Zachary Lane adjacent to Harrison Hills Addition; and
WHEREAS, it was determined by the City Council that street, slope and utility
easements adjacent to Zachary Lane adjacent to Harrison Hills Addition are not
needed for public purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH as follows:
1. That the following portion of street, slope and utility ease-
ments adjacent to Harrision Hills Addition be vacated:
A permanent easement for slope and utility purposes across the tract
or parcel of land lying and being in the County of Hennepin and State
of Minnesota described as follows, to -wit:
That part of the N.W. 1/4 of the S.W. 1/4 of Section 1, Township
118, North, Range 22 West, as follows: Commencing at the point
of intersection of the south line of the N.W. 1/4 of the S.W. 1/4
of Section 1 and a line being distant 67 feet easterly and
parallel to the west line thereof; thence run northerly along
said parallel line to a point distant 75 feet southerly of its
Intersection with the southerly right-of-way line of Hennepin
County State Aid Road No. 10; thence run northeasterly along a
line passing through a point on said southerly right-of-way line
distant 142 feet easterly of the west line of Section 1 to its
point of intersection with a line being distant 87 feet easterly
and parallel to said west line; thence run southerly along said
parallel line to its intersection with the south line of said
N. W. 1/4 of the S.W. 1/4; thence run westerly along said south
line to the pont of beginning and there terminating.

A permanent easement for slope and utility purposes across the tract
or parcel of land lying and being in the County of Hennepin and State
of Minnesota described as follows, to -wit:
That part of the S.W. 1/4 of the S.W. 1/4 of Section 1, Township
118 North, Range 22 West, as follows: Commencing at the point of
Intersection of the south line of Section 1 and a line being
distant 67 feet easterly of and parallel to the west line of
Section 1; thence run northerly along said parallel line to its
point of intersection with the north line of the S.W. 1/4 of the
S.W. 1/4 of Section 1; thence run easterly along said north line
to its point of intersection with a line being distant 87 feet
easterly, and parallel to the east line of Section 1: thence run
southerly along said parallel line to its point of intersection
with the south line of Section 1, thence run westerly along said
south line to the point of beginning and there terminating.

A permanent easement across the tract or parcel of land lying and
being In the County of Hennepin and State of Minnesota described as
follows, to -wit:
10 That part of the S.W. 1/4 of the S.W. 1/4 of Section 1, Township 118
North, Range 22 West as follows: All that portion of the S.W. 1/4 of
the S.W. 1/4 of Section 1 lying Westerly of a line being 67 feet
Easterly and parallel to the East line of Section 1, excepting there-
from the right-of-way of existing road.

2. That said vacation shall not affect the authority of any person,
corporation or municipality owning or controlling electric or tele-
phone poles and lines, gas and sewer lines, or water pipes, mains and
hydrants thereon or thereunder, to continue maintaining the same or to
enter upon such way or portion thereof vacated to repair, replace,
remove or otherwise attend thereto.
