Counciimember Neils introduced the following Resolution and
moved its adoption:
RESOLUTION NO. 83- 653
SURFACE WATER MANAGEMENT TIME EXTENSION
ELM CREEK WATERSHED
WHEREAS, pursuant to Chapter 509 all of the communities within the Elm Creek
Watershed requested that the required Water Management Organization (WMO) be
established by joint powers agreement; and
WHEREAS, a joint powers agreement existed prior to the adoption of Chapter 509;
and
WHEREAS, the existing Elm Creek Watershed Commission has completed a draft of
a revised joint powers agreement to bring the organization in compliance with
Chapter 509; and
WHEREAS, the 1983 legislature reviser Chapter 509 to extend the statutory dead-
line for the formation of the WMOs to July 1, 1984 if reasonable progress is
being made on the formation of the WMO; and
WHEREAS, the Elm Creek Commission projects that the joint powers agreement will
be completed and presented to the communities for adoption within ninety days;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA that a request be made to the Metropolitan Council on behalf of all
the communities within the Elm Creek Watershed for an extension of the statutory
deadline to July 1, 1984 for the formation of a WMO by joint powers agreement
within the Elm Creek Watershed.
