RESOLUTION NO. 83- 633
APPROVING SITE PLAN, CONDITIONAL USE PERMIT AND VARIANCES FOR THOMAS HEALEY, TIMBERTON
COMPANY (83054)
WHEREAS, Thomas Healey, Timberton Company, has requested approval of a Site Plan, Con-
ditional Use Permit and Variances for 148 condominiums to be located southwest of 28th
Avenue North and Ranchview Lane; and,
WHEREAS, the Planning Commission has reviewed said request and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN-
NESOTA, that it should and hereby does approve the request for Thomas Healey, Timberton
Company, for Site Plan, Conditional Use Permit and Variance approval for 148 condo-
miniums to be located southwest of 28th Avenue North and Ranchview Lane, subject to the
following conditions:
1.
Compliance
with City Engineer's Memorandum.
2.
Payment of
park dedication
fees -in -lieu of dedication in accordance with
Dedication
Policy in effect
at the time
of Building Permit issuance.
3.
Submission
of required Site
Performance
Agreement and financial guarantee for
completion
of site improvements.
4.
The private
trails shall be
constructed
per City standards.
5.
Yard setback variances are
granted as
identified in the project narrative
dated October 18, 1983.
6. Permits may be Issued for a building to be used as a model prior to the ap-
proval of the Final Plat and Development Contract, and prior to the filing of
the Final Plat; provided that no occupancy of the building will be permitted
and no further Building Permits for other buildings will be Issued until the
Final Plat has been filed with Hennepin County. Ordinance requirements for
Site Improvements Performance Agreements, and financial guarantee will be
satisfied prior to the issuance of the initial Building Permits, and the re-
quired financial guarantee for site restoration and erosion control shall be
submitted prior to any site grading and utility work. Other financial guar-
antee requirements set forth in the Development Contract are deferred until
the Final Plat and Development Contract have been approved.
The motion for adoption of the foregoing Resolution was duly seconded by
