HomeMy WebLinkAboutCity Council Resolution 1983-561Councllmember Moen Introduced the following Resolution and moved Its adoption: RESOLUTION NO. 83- 561 APPROVING A CONDITIONAL USE PERMIT FOR HENRY BIERBRAUER FOR TOWN TAXI COMPANY (83045) WHEREAS, Henry Bierbrauer has requested approval of a Conditional Use Permit to conduct a business which Includes major auto repair in the 8-3 District to he located at 11318 Highway 55; and, WHEREAS, the Planning Commission has reviewed the matter at a duly called Public Hearing; NOW, THEREFPRE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that It should and hereby does approve the request of Henry Bierbrauer for a Conditional Use Permit to conduct a business which Includes major auto repair in the B-3 District to be located at 11318 Highway 55 subject to the following conditions: 1. The permit is subject to all applicable codes, requtations and Ordinances, and violation thereof shall be grounds for revocation. 2. The permit is Issued to the petitioner as operator of the facility and shall not be transferable. 3. The site shall be maintained in a sanitary manner. 4. All waste and waste containers shall be stored Internally. 5. Any signage shall conform with the City Ordinance standards. 6. There shall be no outside display sales or storage of merchandise, related materials, or parts. 7. All auto repair is limited to those vehicles in the taxi fleet. 8. The permit shall be renewed in one year to assure compliance with the conditions. 10. Contemplated sales between the taxi company and the fleet drivers do not qualify as "retail sales" and these sales will not be open to the public. 11. Prior to issuance of the Permit, and to occupancy, the petitioner and/or the property owner shall: a. Submit a revised Site Plan to the Planning Director for approval of a curb design at the west end of the building, and alonq the west and north driving areas of the site which will delineate the driveway to the west overhead door, and which will Inhibit vehicular access outside approved driving areas. b. Submit a current financial Guarantee for remaining and revised site Improvements. e. Execute a Site Performance Agreement for completion of all approved site Improvements before May 1, 1984.
